Common use of Pay for Accumulated Vacation Clause in Contracts

Pay for Accumulated Vacation. Each City employee who leaves the employment of the City shall be granted all accumulated vacation or shall be paid therefore at his/her rate of compensation applicable at the time he/she leaves the employment of the City. Due to the fact that employees seldom terminate on the final day of a month, the following method shall provide for equitable payment for vacation earned during the month of termination. If an employee terminates on a day falling on the first (1st) through the fifteenth (15th) of a month, the employee shall receive credit for one-half (½) of the months’ vacation accrual; if an employee terminates on a day falling on the sixteenth (16th) through the thirty-first (31st) day of a month, the employee shall receive full credit for the vacation accrual for the month. No leave credit shall be earned on terminal leave payments. When separation is caused by the death of any employee, payment shall be made to the estate of such employee or, in applicable cases, as provided by the Probate Code of the State.
