Common use of Payment of Annual Leave Clause in Contracts

Payment of Annual Leave. (a) If an employee takes annual leave during a period, the annual leave shall be paid at the employee’s base rate of pay for the employee’s ordinary hours of work in the period. (b) An employee going on leave may elect to be paid: (i) prior to commencing such leave; or (ii) through their normal pay cycle. (c) Once the leave has commenced the election cannot be changed unless the Employer agrees. (d) If, when the employment of an employee ends, the employee has a period of untaken paid annual leave, the employer must pay the employee the amount that would have been payable to the employee had the employee taken that period of leave. (e) Annual leave loading, if any, shall be paid in accordance with clause 21.6.
