Payment on termination for leave not taken 17.9.1 Where the employment of an employee is terminated otherwise then by their death and any long service leave - 17.9.1(a) to which the employee was entitled has not been taken or; 17.9.1(b) accrues to the employee upon such termination; then 17.9.2 where an employee dies and any long service leave -
Payment on termination for leave not Taken a) Where the employment of an employee is terminated otherwise than by his/her death and any long service leave: i). to which the employee was entitled has not been taken; or ii). accrues to the employee upon such termination, the employer shall forthwith pay to the employee in full the amount in respect of such leave calculated as at the date of the termination in the manner set out in clause 23.6 hereof less any amount already paid to the employee in respect of that leave.
Payment on termination for leave not taken (a) Where the employment of an employee is terminated otherwise than by their death, and any long service leave, to which the employee was entitled has not been taken or accrues to the employee upon such termination, NAB shall pay to the employee in full the amount in respect of such leave calculated as at the date of the termination, less any amount already paid to the employee in respect of that leave. (b) Where the employee dies and any long service leave to which the employee was entitled has not been taken or accrued upon termination of the employment by reason of their death, NAB shall pay the amount in respect of such leave calculated as at the date of death of the employee, less any amount already paid to the employee in respect of that leave either to the employee’s personal representative or in the following manner: (i) to the widow or widower of such employee; or (ii) if there is no such widow or widower then to or on behalf of the child or children of the employee in equal shares if there should be more than one child; or (iii) if there is no widow or widower or children then to such person who in NAB’s opinion was at the time of death of the employee a dependant relative and if more than one such dependant relative, then equally between them.

  • Payment on Termination If an employee is terminated after the end of a year of employment, the employee is deemed to have been given any untaken leave from the date of termination and shall be paid for that leave accordingly. The employee shall also be paid for any public holidays falling within the period of leave in addition to payment for the leave. If an employee is terminated before the end of a full year of employment, the employee shall be paid pro-rata annual leave based on the period of service.

  • Repayment on Termination Date The Borrower hereby agrees to repay the outstanding principal amount of (i) all Revolving Credit Loans in full on the Revolving Credit Maturity Date, and (ii) all Swingline Loans in accordance with Section 2.2(b) (but, in any event, no later than the Revolving Credit Maturity Date), together, in each case, with all accrued but unpaid interest thereon.

  • Payment on Early Termination Upon termination pursuant to Section 14 (Early Termination), District shall pay Contractor as follows: (i) If District terminates this Contract for its convenience under Section 14(a) or 14(b), then District must pay Contractor for work performed before the termination date if and only if Contractor performed in accordance with this Contract. Upon termination of this Agreement in accordance with this Section 7.1, each party’s further rights and obligations hereunder, other than the provisions of Section 8 and Section 9, shall terminate and be of no further force and effect and no party shall have any liability hereunder, except that neither the Sellers nor the Purchasers shall be relieved or released from any liabilities or damages arising out of its breach of any provision of this Agreement prior to termination.

  • Payment on Death If an employee dies who was entitled to accumulated annual leave under the provisions of this Article, the heirs of such deceased employee shall be paid an amount of money equal to the number of unused hours of annual leave earned or accrued multiplied by the hourly rate of such deceased employee.

  • Automatic Termination This Agreement shall automatically and immediately terminate in the event of its “assignment” (as defined in the 1940 Act).
