Payments from Settlement Fund. Google shall make the following payments from the Settlement Fund in this order:
Payments from Settlement Fund. The total amount distributed to the Settlement Class Members shall be the Settlement Fund and any earnings thereon, less the Settlement Administration Costs and any amount awarded by the Court for any Fee and Expense Award to Class Counsel and any Service Awards. Payments will be made directly by the Settlement Administrator from the Settlement Fund in this order:
Payments from Settlement Fund. After Court-approved deductions from the Settlement Fund for Class Counsel Fees, the Class Representative Service Payment, and Administrative Costs, the Settlement Fund shall be distributed as follows: (1) Settlement Class Members who submit a claim attesting that they suffered harm will be entitled to a payment, on a pro rata basis; and (2) those approximately 94 individuals for whom Defendant’s records show disputed information in the SSN Trace section of their background reports, which was then revised, shall not have to submit a Claim Form in order to receive a payment from the Settlement Fund, and instead will be entitled to an automatic payment, on a pro rata basis, as long as their Email Notice and Mail Notice are not both returned as undeliverable. The amount of each pro rata payment will be determined by the number of Claim Forms submitted. Payments shall be made via check or digital payment at the Settlement Class Members’ election. If no election is made, payment will be made by check.
Payments from Settlement Fund. The costs of settlement administration, including notice and distributions to members of the Final Settlement Class, the costs of administrating the Settlement Fund, and reasonable fees of the Settlement Administrator, Plaintiff’s Counsel’s Fees and Expenses and Class Representative’s Service Award shall be paid exclusively from the Settlement Fund. There will be no reversion of the Settlement Fund to Livingston.
Payments from Settlement Fund. The Settlement Fund shall be used to pay, in the following order: (1) all Notice and Administrative Expenses, up to $300,000; (2) any award of Attorneys’ Fees and Expenses approved by the Court; (3) any Service Award to the Class Representative as approved by the Court; and (4)
Payments from Settlement Fund. The cost of the Identity Theft Protection Package, settlement administration, including notice and distributions to members of the Final Settlement Class, the costs of administrating the Settlement Fund, and reasonable fees of the Settlement Administrator, Class Counsel’s Fees and Expenses and Class Representatives’ Incentive Awards shall be paid exclusively from the Settlement Fund. There will be no reversion of the Settlement Fund to FMC.
Payments from Settlement Fund. Within fifteen (15) business days of the date on which the Aggregate Settlement Amount is deposited into the Settlement Fund, the Settlement Administrator shall allocate and distribute the Settlement Fund to the Class Members. The payment by check will be in the amount per paragraph 4.a.
Payments from Settlement Fund. The cost of the Identity Theft Protection Package, settlement administration, including notice and distributions to members of the Final Settlement Class, the costs of administrating the Settlement Fund, and reasonable fees of the Settlement Administrator, Plaintiffs’ reasonable attorneys’ fees and litigation costs, and any Incentive Award to the Class Representatives shall be paid exclusively from the Settlement Fund. The cost of the Identity Theft Protection Package from Experian is estimated by Plaintiffs to be $481,270.05. There will be no reversion of the Settlement Fund to Rady. A portion of the Settlement Fund may be allocated to identity theft protection and/or credit monitoring.
