Performance of Work by City. If the Contractor fails to perform the Work in accordance with the schedule referred to in section 2 above, the City may, in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the Contractor notice of its intention. The Contractor shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.
Performance of Work by City. If the University fails to perform the Work to a quality expected by the City, the City may, in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall first give the University a 30-day written notice of its intention by certified mail, return receipt requested. The City may declare the University in default if University fails to cure such default within said 30 day receipt of written notification. In such event, the University shall only be compensated for those tasks specified in Exhibit A or any individual task assignment herein, which has been completed as of the date of default. In the event partial payment has been made for such services not completed, the University shall return such sums to the City within thirty (30) days after receipt of written notice, by certified mail, return receipt requested that said sums are due.
Performance of Work by City. If the NPO fails to perform the Work in accordance with this contract, including the attachment containing the Scope of Work, the City may in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the NPO notice of its intention. The NPO shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.
Performance of Work by City. If Seller fails to perform the Work in accordance with the schedule required by this contract, the City may, in its discretion, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give Seller notice of its intention. Seller shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.
Performance of Work by City. Continuity of the work is based on satisfaction of performance. If the Contractor fails to perform the Work in accordance with the schedule referred to in section 2 above, the City may, in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the Contractor notice of its intention. The Contractor shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.

If the Contractor fails to perform the Work according to the schedule agreed upon the parties, and set forth at Attachment C, which is incorporated with this Agreement by reference to the Attachment C, the City may, in its sole discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work; and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the Contractor notice of its intention. The Contractor shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this Section.

The Contractor shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section. Sec. 9. Exhibits – There are no exhibits to this contract.

If the Contractor materially fails to perform the Work in accordance with Exhibit A and any applicable Statement of Work and such failure is not the result of the actions or inactions of the City, the City may, in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the Contractor thirty (30) days advance notice of its intention and allow the Contractor to bring the work back into line with the requirements of Exhibit A and the applicable Statement of Work. The Contractor shall reimburse the City for any reasonable additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.
Performance of Work by City. If the Contractor fails to perform the Work in accordance with the requirements of Exhibit A or within the schedule shown in Exhibit B Project Schedule, as required by this contract, the City may, in its discretion, in order to bring the project closer to the schedule, perform or cause to be performed some or all of the Work, and doing so shall not waive any of the City’s rights and remedies. Before doing so, the City shall give the Contractor notice of its intention. The Contractor shall reimburse the City for additional costs incurred by the City in exercising its right to perform or cause to be performed some or all of the Work pursuant to this section.
