Common use of Permanent Promotional Vacancies Clause in Contracts

Permanent Promotional Vacancies. Permanent vacancies above the rank of patrolman shall be filled by promotional examination, unless abolished. Where the Employer determines that a permanent vacancy is to be abolished and not filled, it shall provide the Union with notice of its decision and at the Union’s request meet to discuss the impact of such decision. No permanent position in a classification above the rank of patrolman shall remain vacant, unless abolished. Where a permanent vacancy occurs and a valid promotional list does not exist, it may be filled on a temporary basis pending the establishment of a list, but no more than one hundred eighty (180) calendar days. All promotions above the rank of patrolman shall be made pursuant to Section 15.4 of this article.
