Permanent Transfer Out of the Bargaining Unit. The selection or appointment of an employee for any position not subject to this Agreement is not covered by this Agreement. If an employee is, or has been, transferred or appointed to a position which is not covered by this Agreement, but fails the applicable probationary period, or to a maximum period of six (6) months, whichever is less, the employee will be returned to the original job classification and wage rate held at the time of transfer, and seniority will continue as if the employee had not transferred out of the bargaining unit. If an employee is returned to a position covered by this Agreement after the applicable probationary period, or within a maximum of six (6) months, whichever is less, the employee’s seniority shall resume at the point the employee held before the transfer out of the bargaining unit position.
