Permanent Vacancies. a) The Employer will post notice of a vacancy in a bargaining unit job within ten (10) working days from the date of the vacancy (providing the position is going to be filled) setting forth the position, location, and shift, and it shall be posted for a period of five (5) working days. A vacancy exists when there are more positions than employees in the bargaining unit. Any interested employee may apply in writing. Permanent Vacancies. (a) The Employer will post notice of Permanent vacancies shall be defined as a vacancy within one of the full- time classifications identified in a bargaining unit job within ten “Appendix C” hereto and which will be in existence for more than thirty (1030) continuous working days from the date and shall exclude any vacancy:
(i) where there is less than forty (40) hours of the vacancy (providing the position is going available work to be filledperformed; or

(c) Permanent vacancies within a particular distribution centre shall first be posted within that facility. Once all the postings within the distribution centre have been filled and a vacancy still exits, this vacancy shall be posted in all other distribution centres covered by the UFCW Local 1000A. In the event that such a posting is not filled with a current full time employee and the Employer decides to add to the overall full time compliment of staff then this opening shall be offered to all part time distribution employees covered by the UFCW Local 1000A in accordance with Article A.08(d). An employee who is transferred to another distribution centre under the portability provisions shall be eligible to exercise their seniority after a period of thirty (30) calendar days following such transfer. All vacancies shall be filled first by full time employees, then by part time employees based on the provisions of Article A.08(d) of the part time appendix of this agreement.
(d) Selection to such vacancy shall be on the basis of bargaining unit seniority provided that the employee who is applying for the vacancy possesses the qualifications and ability necessary to perform the work in question.
(e) If a successful applicant is unable to perform the normal requirements of the position he shall be returned to his former position at his former rate of pay.
(f) If there is no successful applicant for a permanent vacancy, the Company shall have the right fill the vacancy either by assigning the vacancy to any employee within the bargaining unit or by filling the vacancy from outside the bargaining unit.
(g) A successful applicant for a permanent vacancy, or an employee who is assigned to fill such vacancy, shall be paid the rate for such vacancy.
(h) A successful applicant for a permanent vacancy shall be prohibited from applying for another permanent vacancy for a period of five (5) working days. All job within ten (10) working days from the date of the vacancy (providing the position is going to be filled) setting forth the position, location, and shift, and it vacancies shall be posted in locations accessible to all employees for a period of five (5) working days. A vacancy exists when there are more positions than employees All job vacancies shall also be listed in the bargaining unitDistrict Administrative Bulletin. f) The employer shall provide on the job training to any employee seeking to upgrade their skills in their current job classification. Upon receipt of appropriate written requests, the training will This demonstration period may be completed within a year. The time and location of the assignment shall be shortened at the discretion of the employer. An employee who is awarded a bid and successfully demonstrates his qualifications shall lose all rights to his former job. If the successful bidder is unable to demonstrate that he has the necessary qualifications, he shall be returned to his original job. Final decision as to ability and qualifications shall be with the employer. With regard to the subsection and to the filling of vacancies the grievance procedure shall apply only to the time lines set forth above and shall not apply to any other subject.

Before the final candidate is recommended to the Board of School Directors for hire in the Maintenance classification the candidate must pass each District required exam with a minimum score of 85%. The District will identify the xxxxxxx to administer both theory concepts and practical hands-on exams. Exams will be conducted at the Steel Valley Area Vocational Technical School and at the convenience of the District identified xxxxxxx. The District will pay all costs associated with the testing including but not limited to administrative fees and licensing fees. The District will pay all costs for the employee to maintain certifications necessary for employment with the District.

Permanent Vacancies. Section 1. Each permanent job vacancy and each permanent new job which falls within the scope of the Union’s certification shall be filled as follows:
(a) The Employer will post notice Notice of a vacancy in a bargaining unit such job within ten (10) working days from the date of the vacancy (providing the position is going to be filled) setting forth the position, location, and shift, and it shall be posted in the plant for two (2) days. A vacancy exists when there are more positions than employees in the bargaining unit. Any interested employee may apply in writing. Permanent Vacancies. (a) The Employer will post notice of Permanent vacancies shall be defined as a vacancy within one of the full-time classifications identified in a bargaining unit job within ten “Appendix C” hereto and which will be in existence for more than thirty (1030) continuous working days from the date and shall exclude any vacancy:
(i) where there is less than forty (40) hours of the vacancy (providing the position is going available work to be filledperformed; or
(ii) setting forth which is caused by the positiontemporary absence of an employee by reason of illness, locationdisability or approved leave of absence. (c) Permanent vacancies within a particular distribution centre shall first be posted within that facility. Once all the postings within the distribution centre have been filled and a vacancy still exits, this vacancy shall be posted in all other distribution centres covered by the UFCW Local 1000A. In the event that such a posting is not filled with a current full time employee and the Employer decides to add to the overall full time compliment of staff then this opening shall be offered to all part time distribution employees covered by the UFCW Local 1000A in accordance with Article A.08(d). An employee who is transferred to another distribution centre under the portability provisions shall be eligible to exercise their seniority after a period of thirty (30) calendar days following such transfer. All vacancies shall be filled first by full time employees, then by part time employees based on the provisions of Article A.08(d) of the part time appendix of this agreement.
(d) Selection to such vacancy shall be on the basis of bargaining unit seniority provided that the employee who is applying for the vacancy possesses the qualifications and ability necessary to perform the work in question.
(e) If a successful applicant is unable to perform the normal requirements of the position he shall be returned to his former position at his former rate of pay.
(f) If there is no successful applicant for a permanent vacancy, the Company shall have the right fill the vacancy either by assigning the vacancy to any employee within the bargaining unit or by filling the vacancy from outside the bargaining unit.
(g) A successful applicant for a permanent vacancy, or an employee who is assigned to fill such vacancy, shall be paid the rate for such vacancy.
(h) A successful applicant for a permanent vacancy shall be prohibited from applying for another permanent vacancy for a period of five (5) working days. c) During the first ten (10) days on his/her new job, the employer will provide assignment specific training to the employee. During the first forty-five (45) working days on his/her new job, a successful applicant may elect to return to his/her former job, or the Employer may elect to retransfer the applicant to his/her former job at the former pay rate and benefit level in the event he/she fails to demonstrate his/her ability to do the required work with written notice of documented reasons with a copy to the President. This shall not be subject to the grievance procedure. If the job is so vacated, the Employer may select another applicant from the earlier posting.
d) After an employee's successful application, he/she shall be ineligible to apply for another posted job for six (6) months. However, if a vacancy arises in a higher paying position, an employee may apply after thirty (30) days in position. Sub-sections c and d do not apply to the Transportation unit (drivers).
e) Employees may submit a request to the Director of Operations and/or Chief Financial Officer Director of Business for a transfer within their classification. The request for transfer should state the reason(s) for the transfer. If the request is not granted the employee will, upon request, be given a written statement indicating the reason(s) for not implementing the transfer. No transfer shall take place until the replacement employee is adequately trained.
f) The employer shall provide on the job training to any employee seeking to upgrade their skills in their current job classification. Upon receipt of appropriate written requests, the training will be completed within a year. The time and location of the assignment shall be at the discretion of the employer.

1. Is at least relatively equal in qualifications and ability.
2. Meets any special physical requirements of the job.
3. Demonstrates a satisfactory attendance record.
4. Submits a Request for Internal Transfer or Promotion.

In the event the senior qualified employee bidding for such vacancy is already classified and working in the same classification as the vacancy, such employee's bid shall not be unreasonably denied. Any employee who successfully bids within his/her same classification shall not be permitted to bid for an additional job within his/her same classification for one (1) year.
D. Any employee who successfully bids into a higher or equal paying position shall receive the appropriate rate of pay based on years of service and the employee's hire date for the new position. Any employee who was red- circled in his/her previous position and who successfully bids into an equal or higher paying classification, shall be entitled to keep his/her red-circled rate, if it is higher than the standard rate for his/her new job, .
E. The College shall have the employer will provide assignment specific training right to the employeerequest job-related assessment for all internal and external applicants in connection with filling a permanent vacancy.
