Common use of Personal Breaks Clause in Contracts

Personal Breaks. (a) The Union agrees that except in cases of personal necessity, employees shall not ask for additional time off during the working day. The Union agrees that rest periods must not be abused. (b) Employees shall not be disciplined or discharged as a result of authorized usage of time for personal breaks granted by the Company. However as a deterrent to excess usage the following measures will apply: (i) Employees will have the time used on each break deducted from their weekly hours worked. (ii) Employees who for reasons supported by medical documentation show a specific condition to exist which necessitates greater use of the washroom will not have time deducted for use of the washroom. (c) The Union agrees to work with the Company to deal with employees who are abusing personal breaks.
