PERSONAL/XXXXX’S LEAVE. 7.3.1 All full time employees shall be entitled to accrue paid personal / xxxxx's leave on the basis of 10 days per year (or pro-rata thereof for any period less than one year). Part-time employees are entitled to a pro-rata benefit. Paid personal / carer's leave is cumulative. 7.3.2 All accrued personal leave shall be available for use as carer's leave in accordance with the provisions outlined below. 7.3.3 As part of its commitment to provide a family-friendly workplace, the employer will allow employees to use any amount of accrued personal /xxxxx's leave to enable employees to: (a) provide primary care to partners, children and/or other household or family members. (b) attend the funerals of family or household members or close family relatives (if compassionate leave is not available in the circumstances). 7.3.4 The leave provided for in this clause will be granted subject to the following: (a) The employee must notify the employer of the reason and likely duration of the absence before 7.00 am on the first day of the absence, unless this is not possible due to an unexpected emergency in which case the employee must notify the employer as soon as practicable. (b) Where circumstances permit, an employee must endeavour to arrange leave to minimise the impact on operational needs. (c) The provision of appropriate documentary evidence. 1. For sick leave, a medical certificate or if not reasonably practicable to provide a medical certificate- a statutory declaration made by the employee. 2. For xxxxx's leave, a medical certificate in respect to the family or household member, or a statutory declaration by the employee. 3. For compassionate leave, any evidence that the employer reasonably requires. 7.3.5 The employee is not entitled to take more than 10 days of paid xxxxx’s leave (1/26th of the nominal hours worked by the employee) per year, regardless of the amount of personal leave the employee has accumulated over time. 7.3.6 An employee may request to cash out any amount of paid personal/xxxxx’s leave that they have accrued that is excess of 3/52 of the number of nominal hours worked over the past 12 months. For example, an employee working 38 hours per week over 12 months must retain 15 days of paid personal/carer’s leave and may cash out any further personal/carer’s leave that has been accumulated. 7.3.7 In addition to the above, a request to cash out personal/xxxxx’s leave will only be granted where: (a) the employee elects to cash out their leave in...

PERSONAL/XXXXX’S LEAVE. 20.1 Employees (excluding casual employees) when absent from work on account of personal illness or an account of injury by accident, other than that covered by Workers’ Compensation, or where the employee is the primary care giver to a Personal family member, will be entitled to leave of absence, without deduction of pay subject to the following conditions and limitations:- 20.1.1 The employee must within 24 hours of the commencement of such absence inform the Company of their inability to attend for duty, and as far as practicable, state the nature of the injury/illness and the estimated duration of such absence. 20.1.2 The employee must prove to the satisfaction of the Company that he/she was unable (on account of such illness or injury or for carer’s leave purposes) to attend for duty on the day or days for which personal/carer’s leave is claimed. 20.1.3 Provided that an employee who has completed one year of continuous employment with the Company will be credited with a further 10 days (76 hours) personal/carer's leave entitlement at the beginning of the second and each subsequent year. 20.2 Subject to the provision of this clause, an employee will be entitled to claim personal/xxxxx’s pay for two (2) single day absences in any year without substantiating documentation. Thereafter, any single day claimed within the same year will be supported by a statutory declaration. For multiple days claimed at any time, the employee will need to supply to the Company’s satisfaction a certificate from a registered health practitioner supporting the fact that the employee was unable to attend for duty on account of personal illness or injury or for the purposes of carer’s leave. 20.3 Untaken personal/cares leave with the Company will accumulate from year to year for a period of ten (10) years, but no longer. 20.4 If any employee is terminated by the Company and is re-engaged within a period of six (6) months, then the employee’s unclaimed balance of personal/carer’s leave will continue from the date of re-engagement. 20.5 Personal leave entitlements are accrued and provided to employees for the purpose of illness or injury as provided in this Clause. Payment of unused entitlements on termination will not be made. 20.6 For the purposes of this clause personal/carer’s leave shall have corresponding meanings (i.e. read and calculated as the same).
PERSONAL/XXXXX’S LEAVE. (a) Personal/ xxxxx's leave includes personal sick leave and xxxxx's leave. Employees (other than casuals) will be entitled to 10 days of paid personal/ carer's leave per year of continuous service. (b) Paid personal/ xxxxx's leave is available to an employee (other than a casual) when he or she is absent due to: o personal illness or personal injury affecting the employee ("personal leave"); or o for the purposes of providing care and support to a member of the employee's immediate family or household because of a personal illness or injury (“xxxxx's leave"). This entitlement is subject to the employee being responsible for the care and support of the person concerned. In normal circumstances an employee is not entitled to take carer's leave where another person has taken leave to care for the same person. Immediate family has the meaning set out in the Act. (c) Employees will be paid Total Salary while on personal/ carer's leave. (d) The balance of any unused personal/ xxxxx's leave will accumulate from year to year. (e) An employee shall, as soon as possible, inform the company of their inability to attend for duty and, as far as possible state the nature of the illness or incapacity and the estimated duration of the absence. In any case, the employee shall inform the company of their inability to attend prior to the transportation pick-up time or the commencement time of the shift, unless it is not practicable to do so. (f) The employee must, if required by the company establish by production of a medical certificate or other form to the satisfaction of the company: (i) that the employee was unable to attend work because of personal injury or personal illness; (ii) that the employee was unable to attend work because they were providing care or support to an immediate family member because of a personal illness, injury or unexpected emergency affecting that member. (g) In the event an employee has exhausted their personal/ carer's leave entitlement or if the employee is a casual employee, the employee may take up to two days unpaid leave to provide care (as outlined above) on each permissible occasion. (h) An employee may request in writing, once per year, to: (i) forfeit a portion of their accrued but untaken personal / carer’s leave and receive a payment at the Total Salary rate in lieu thereof; or (ii) Subject to the NES, salary sacrifice into an approved superannuation fund nominated by the employee any future personal leave entitlements provided th...
PERSONAL/XXXXX’S LEAVE. 17.1 Entitlement to paid personal/carer’s leave a) Paid personal leave will be available to an Employee (other than casual Employees) when they are absent due to: (i) personal illness or injury (sick leave); or (ii) for the purposes of caring for an immediate family or household member who is sick and requires the Employee's care and support (carer's leave). b) The amount of personal leave to which an Employee is entitled is as follows: (i) Upon commencement of employment Employees will automatically be credited with 5 days Personal and/or Xxxxx’s leave. After 6 months of employment, the leave will begin to accrue progressively up until it reaches 10 days at the conclusion of 12 months employment. (ii) Once the Employee has completed one year of continuous employment, the Employee shall be credited with a further ten days personal leave entitlement at the beginning of the Employee's second and subsequent year, which subject to clause 17.1(f) hereof, shall commence on the anniversary of engagement. c) In any year unused personal leave accrues. d) An Employee will inform the Company of the Employee's inability to attend for duty, and need to take personal leave, as soon as practicable. e) An Employee shall prove to the Company's satisfaction that the Employee’s Personal/Xxxxx’s leave is/was justified. Such evidence may be a medical practitioner’s certificate, or a statutory declaration. An Employee will not be required to provide such evidence for single days of absence but only where two or more consecutive days of absence are taken. f) If an Employee’s employment is terminated by the Company and is re-engaged within a period of six months, then the Employee's unclaimed balance of sick leave shall continue from the date of re-engagement. In such case the Employee's next year of service will commence after a total of twelve months has been served with that Company excluding the period of interruption in service from the date of commencement of the previous period of employment or the anniversary of the commencement of the previous period of employment, as the case may be. g) Unpaid carer’s leave will be in accordance with the NES.
PERSONAL/XXXXX’S LEAVE. Employees may take Personal/Xxxxx’s leave: a) If Employees are not fit for work because of a personal injury or illness; or b) To provide care or support to a member of their immediate family or household who requires care or support because of: i. A personal illness or injury affecting the member; or ii. An unexpected emergency affecting the member; c) Employees may also take personal/xxxxx’s leave for a maximum of up to one shift to attend the funeral of a close personal friend.

PERSONAL/XXXXX’S LEAVE. The term personal/carer’s leave effectively covers both sick leave and xxxxx’s leave. A full-time employee is entitled to claim up to 10 days paid personal/carer’s leave, for each year of continuous service, for absences due to: • personal illness or injury of the employeeto provide care and support to a member of the employee’s immediate family • to provide care and support to a member of the employee’s immediate family • to provide care and support to a member of the employee’s household, because of the illness or injury of that member or an unexpected emergency affecting that member 23 Part-time employees are entitled to leave under this clause on a pro rata basis based on the number of ordinary hours worked. Casual employees are not entitled to personal/carer’s leave. Personal/xxxxx’s leave accrues on an hourly basis and is paid at the employee’s ordinary rate of pay. Personal/xxxxx’s leave is cumulative but unused leave is not paid out on termination of the employment contract. Personal/xxxxx’s leave is not allowed to be cashed out under the terms of this agreement. Where an employee has insufficient accrued personal/carer’s leave, the employee is entitled to take up to 2 days unpaid carer’s leave on each occasion carer’s leave is required.
PERSONAL/XXXXX’S LEAVE. 22.1 For each year of service with the Company, an employee shall be entitled to 12 shifts of paid personal/carer’s leave without loss of pay. 22.2 An employee's entitlement to paid personal/carer's leave shall accrue progressively during a year of service according to the employee's ordinary hours of work and shall accumulate from year to year. 22.3 An employee may take paid personal leave if the leave is taken because the employee is not fit for work because of personal illness or injury. 22.4 An employee may take paid xxxxx’s leave if the leave is taken to provide care or support to a member of the employee's immediate family, or a member of the employee's household, who requires care or support because of a personal illness or injury or an unexpected emergency. 22.5 For the purposes of clause 22.4 above ‘immediate family’ means a spouse, de facto partner, child, parent, grandparent, grandchild or sibling of the employee, or a child, parent, grandparent, grandchild or sibling of a spouse or de facto partner of the employee. 22.6 In accordance with the NES, employees may access periods of unpaid leave of at least two (2) days, or a greater period by agreement with the Company, that meets the requirements of clause 22.4 above. However, an employee cannot take unpaid carer's leave if the employee could instead take paid personal/carer's leave. 22.7 An employee on personal/xxxxx’s leave who is absent for only part of a shift, shall have a proportionate amount deducted from their personal/carer’s leave accrual in accordance with the following formula: Period of Absence Deduction from Leave i. Up to ¼ of a shift Nil ii. Between ¼ and ¾ of a shift ½ shift iii. ¾ or more of a shift Total duration of absence (up to 1 shift) 22.8 If the period during which an employee on the early/late roster takes paid personal/xxxxx's leave includes a day or part-day that is a public holiday the employee shall be taken not to be on paid personal/carer's leave on that public holiday.

Part-time Employees are entitled to the pro-rata equivalent. 8.4.2 Paid personal / xxxxx's leave accrues progressively during each year of service according to the Employee's ordinary hours of work, and accumulates from year to year. 8.4.3 All accrued personal/carer’s leave shall be available for use as sick leave and carer's leave in accordance with the provisions outlined below. 8.4.4 An Employee (other than a casual Employee) may take paid personal/carer’s leave if the leave is taken: (a) As sick leave - because the Employee is unfit for work as a result of a personal illness, or personal injury, affecting the Employee; or (b) As carer’s leave - to provide care or support to a member of the Employee’s immediate family, or a member of the Employee’s household, who requires care or support because of: (i) a personal illness, or personal injury affecting the immediate family or household member, or (ii) an unexpected emergency affecting the immediate family or household member. 8.4.5 An Employee (including a casual Employee) may take 2 days unpaid carer’s leave per occasion if: (a) the leave is taken to provide care or support as provided for in sub-clause 9.4.5(b) of this Agreement; and (b) the Employee does not have any paid personal/carer’s leave available.
