Personal Data Breach Response. Upon becoming aware of a Personal Data Breach, Clarivate shall: (i) notify Client without undue delay, and where feasible, in any event no later than 48 hours upon determining that a Personal Data Breach has occurred; (ii) provide timely information relating to the Personal Data Breach as it becomes known or as is reasonably requested by Client; and (iii) promptly take reasonable steps to contain and investigate any Personal Data Breach. Client agrees that an unsuccessful Personal Data breach will not be subject to this Section 4(d). An unsuccessful Personal Data Breach is one that results in no unauthorised access to Client Personal Data or any facilities or equipment of Clarivate storing Client Personal Data. Clarivate's notification of or response to a Personal Data Breach under this Section 4(d) shall not be construed as an acknowledgment by Clarivate of any fault or liability with respect to the Personal Data Breach.

To the extent that Customer requires additional information in order to meet its Personal Data Breach notification obligations under EU Data Protection Laws, New Relic shall provide timely information relating to the Personal Data Breach as it becomes known or as is reasonably requested by Customer. Where and insofar as it is not possible to provide the information at the same time as the notification, New Relic shall provide the information in phases without further undue delay.
