Common use of Personal Harassment Clause in Contracts

Personal Harassment. 5.1.2 Personal Harassment includes conduct and/or behaviours which create an intimidating, demeaning or hostile working or academic environment whether or not it is based on the prohibited grounds defined in the Human Rights Code and listed in Clause 2. For the purposes of this Article, Personal Harassment includes Workplace Harassment as defined under the Occupational Health and Safety Act as engaging in a course of vexatious comment or conduct against a worker in a workplace that is known or ought reasonably known to be unwelcome.

Examples of personal harassment include: • discriminatory behavior in violation of human rights legislation • physical threats, abuse, assault, intimidation • verbal abuse • displays of pornographic, and/or racist pictures, photographs, literature not related to an intimidating, demeaning or hostile working or appropriate academic environment whether or not it is based on the prohibited grounds defined in the Human Rights Code and listed in Clause 2. For the purposes context of this Article, Personal Harassment includes Workplace Harassment as defined under the Occupational Health and Safety Act as engaging in a course creating awareness of vexatious comment or conduct against a worker in a workplace that is known or ought reasonably known to be unwelcomesuch materials.

For the purposes of this Article, Personal Harassment includes Workplace Harassment as defined under the Occupational Health and Safety Act as engaging in It means any improper behaviour by a course of vexatious comment or conduct against a worker in a workplace person that is directed at and/or is offensive to any Member and which that person knew or might reasonably have known would be inappropriate, unwelcome, unwanted or ought reasonably known likely to be unwelcomecreate an intimidating or hostile work environment.
