PIPEDA. The Contractor represents and warrants that if it is or becomes subject to any private sector legislation during the Term it will be solely responsible for compliance with such legislation. Without limitation, the Contractor represents and warrants that if it is subject to the Personal Information Protection and Electronic Documents Act, S.C. 2000, c. 5, including any further amendments thereto (PIPEDA):
a) it and all of the Contractor’s sub-contractors shall ensure the PIPEDA compliance of all PIPEDA Protected Information it collects directly from individuals or indirectly from the Board or others, uses or discloses in the course of performing their obligations under this Agreement; and,
b) without limitation it shall ensure the PIPEDA compliance of all PIPEDA Protected Information it transfers or discloses to the Board.
PIPEDA. The Union and the Employer agree to endorse the principles outlined in the Personal Information Protection and Electronic Documents Act. The Union and the Employer also agree to apply privacy protection principles to any personal information that is disclosed to either party during the course of the administration of the collective agreement and the collective bargaining relationship. The Union and the Employer agree that the Employer's privacy policy shall govern both the Union's and the Employer's obligations to protect personal information about employees.
PIPEDA. The Union and the Company agree to endorse the principals outlined in the Personal Information and Electronic Documents Act. The Union and the Employer also agree to apply privacy protection principles to any personal information that is disclosed to either party during the administration of the Collective Agreement and the collective bargaining relationship.
PIPEDA. To the extent applicable, each party shall comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) in connection with their performance under this Agreement.
PIPEDA. 6.1 You acknowledge that Canada’s federal Personal Information Protection and Electronic Documents Act (PIPEDA) applies to you and us.
6.2 You therefore agree to operate in compliance with your obligations under PIPEDA, and without limiting the generality of the foregoing you agree to:
i. maintain, and where necessary, implement the necessary security mechanisms and procedures to ensure against the direct or indirect unauthorized access, use, disclosure, alteration, loss or destruction of any Personal Information provided by us or otherwise obtained by you in the course of your performance of the services; and
ii. when requested by us, co-operate with the fulfillment of our obligations under PIPEDA.
6.3 Your obligations with respect to PIPEDA set out herein shall survive the expiration of this agreement and shall remain in force indefinitely.
PIPEDA. The Individual represents and warrants that if it is or becomes subject to any private sector privacy legislation during the Term of this Agreement, it will be solely responsible for compliance with such legislation. Without limitation, the Individual represents and warrants that if it is subject to the Personal Information Protection and Electronic Documents Act, S.C. 2000, c.5, including any further amendments thereto (PIPEDA):
PIPEDA. This assistance is limited to existing information and processes within the GotPhoto system as well as information relating to the data processing carried out by GotPhoto on behalf of the Photographer.
PIPEDA. The Union and the Employer agree to endorse the principles outlined in the Personal Information
PIPEDA. Each Party, its agents and subcontractors and all employees or other representatives of any of them shall comply with the Personal Information Protection and Electronic Documents Act (Canada). In the event of any change, modification or adoption of a new provision to the said Act from the present version in effect on the date of this Agreement, the BCH Companies shall request that Certen provide an estimate of the reasonable additional costs and expenses that would be incurred by Certen to do same and time required to implement same together with supporting documentation to justify the estimate. The BCH Companies shall then decide whether Certen shall effect same and if the BCH Companies does so decide Certen shall implement same and the BCH Companies shall reimburse Certen's reasonable and pre-approved expenses incurred in so doing.
PIPEDA. To enable CME to perform under this User Agreement, Company will need to provide personal data to CME. All data provided by Company will be kept secure and confidential and will only be used for the purpose of (1) processing and implementing the User Agreement, and (2) complying with the Canadian Laws and Regulations governing the trading, clearing and reporting of derivatives unless the Company consents to CME using it for another purpose. Such use may involve the transfer of this data outside Canada. In storing and processing the Company’s data for purposes of the User Agreement, CME will comply with the provisions of PIPEDA, including the data protection principles set out in PIPEDA, or any other applicable Canadian personal information protection law.
