Police Exercise Room. The Exercise Room (ROOM) in the police facility will be supplied with equipment by the Association. The equipment will be the solely owned property of the Association. The ROOM will continue to be used as such, unless in the City's sole judgment, legal liability or space prioritization concerns make it unfeasible to continue to allow it. The Association agrees that the use of the ROOM shall not be within the scope of representation under Government Code Section 3504. The City agrees to maintain the ROOM and all equipment. If the City requires closure of the ROOM and the Association has no suitable alternative for placement of the equipment, the City will purchase all of the exercise equipment at its original purchase price. Use of the ROOM and its equipment will be restricted. Only those employees of the City, who are sworn police personnel under Section 830.1 of the California Penal Code, will be allowed to use the ROOM and its equipment. Additionally, Reserve Police Officers of the City of Simi Valley are authorized to use the ROOM for the purpose of exercise. Unless mutually agreed by the Association's Board of Directors and the City, no other persons may use the ROOM for the purposes of exercise. Authorized personnel may only use the ROOM when they are off-duty. At no time will any authorized person use the equipment unless at least one other authorized person is present. (The restriction that employees not exercise alone applies only to the use of free weights.) Family members and friends of authorized personnel may not use the facility. Access to the ROOM is restricted to those authorized above and for other City business as deemed necessary by the Chief of Police. Rules of Conduct, based on common sense and safety, will be drafted by joint agreement by the Chief of Police and the Association. The rules of conduct will be posted conspicuously in the ROOM. All authorized persons who use the ROOM will agree to abide by these Rules. The ROOM will be available on a daily, twenty-four-hour-per-day basis. The Chief of Police shall be responsible for insuring that only authorized persons use the ROOM in a manner consistent with safety and common sense. Bearing this in mind, a General Order will be drafted to insure that the continued use meets these standards and will mandate the use of the ROOM be governed by the Directive System.   • Optional Life and Disability Coverages In order for coverage to become effective, the employee must be in active payroll status and not using sick leave on the first day following approval by the insurance company. If it is an open enrollment period, coverage may be applied for but will not become effective until the first day of the employee's return to work.

  • Integration with Other Disability Income In the event a totally disabled employee is entitled to any other income as a result of the same accident, sickness, mental or nervous disorder that caused him/her to be eligible to receive benefits from this Plan, the benefits from this Plan will be reduced by one hundred percent (100%) of such other disability income. Other disability income shall include, but not necessarily be limited to:

  • STATE DISABILITY INSURANCE (SDI) A. All employees covered by this Contract will be covered under the State Disability Insurance (SDI) benefit in lieu of a Non-Industrial Disability Insurance (NDI) and Enhanced Non-Industrial Disability Insurance (ENDI) benefit as follows:

  • Expiration of Sick Leave Credits Employees who are absent due to sickness beyond their accumulated sick leave credits shall be placed on an unpaid leave of absence until they are in receipt of long-term disability benefits. (Reference Article 37 - Leave – General and Appendix A – Long-Term Disability Insurance Plan.)

  • Sick Leave Use Sick leave will be charged in one-tenth (1/10th) of an hour increments and may be used for the following reasons:

  • Extended Disability Leave a. Due to a medical disability, an employee shall be granted an extended leave of absence without pay (subject to Paragraph d hereof) if any one of the following conditions exists:

  • State Disability Insurance (“SDI”) 215. Employees in the bargaining unit(s) covered by this agreement shall be enrolled in the State Disability Insurance Program. The cost of SDI will be paid by the employee through payroll deduction at a rate established by the State of California Employment Development Department.

  • Early Retirement Option The District may offer an early retirement incentive for unit members.

  • Termination due to Force Majeure 13.5.1 If the Force Majeure Event or its effects continue to be present beyond the period as specified in Article 4.5.3, either Party shall have the right to cause termination of the Agreement. In such an event, this Agreement shall terminate on the date of such Termination Notice.

  • Successive Disabilities If, following a period of total disability with respect to which benefits are paid from this Plan, an employee returns to work for a continuous period of six (6) months or more, any subsequent total disability suffered by that employee, whether related to the preceding disability or not, shall be considered a new disability and the disabled employee shall be entitled to benefit payments after the completion of another waiting period. In the event the period during which such an employee has returned to work is less than six (6) months and the employee again suffers a total disability that is related to the preceding disability, the subsequent disability shall be deemed a continuation of the preceding disability, and the disabled employee shall be entitled to benefit payments without the necessity of completing another waiting period. Should such an employee suffer a subsequent disability that is unrelated to the previous disability and provided the period during which the employee returned to work is longer than one (1) month, the subsequent disability shall be considered a new disability and the employee shall be entitled to benefit payments after the completion of another waiting period. If the period during which the employee returned to work is one (1) month or less, the subsequent disability shall be deemed a continuation of the preceding disability and the disabled employee shall be entitled to benefit payments without the necessity of completing another waiting period.
