Policy Dispute. Any dispute concerning the interpretation of the terms, conditions, limitations and/ or exclusions contained herein shall be governed by Indian law and shall be subject to the jurisdiction of the Indian Courts.

Policy Dispute. If a difference of a general nature arises between the Union or its members and the Employer concerning the interpretation, application, operation or alleged violation of this Agreement or Memoranda, the aggrieved party may submit a written grievance to the other party within twenty-one (21) calendar days of becoming aware of the matter giving rise to the difference, and Step 3 of Article 9.02 shall apply. A copy of the grievance shall in every case be forwarded to the Union and the EHSC. Where the Employer produces a written policy which has application throughout the worksites, a grievance regarding the policy may be filed at one (1) worksite. If the grievance is resolved or arbitrated, the resolution reached will be binding on all EHSC worksites. If the grieved policy has limited application throughout the EHSC, the EHSC Representative at the Step 3 grievance meeting will confirm with the Union to which work sites the policy does not apply.

The expense of the examination by the third party shall be shared equally by the University and the employee.
