In no instance shall a callback to duty be considered as less than two hours for pay purposes. No employee shall be paid for call back time and standby simultaneously. All employees excluded from the overtime provisions of these Articles are also excluded from the provisions of this Section.

All Sec. 603 ASSIGNMENT PAY: Effective July 30, 2006, all VCDSA members assigned to the Sheriffs’ Major Crimes Unit, as identified on the document attached hereto as Exhibit B developed and agreed to by both VCDSA and Sheriffs’ Management, shall receive an assignment pay equal to seven and one half percent (7.5%) of base salary. Effective July 1, 2007 all VCDSA members, whose primary function is investigations, as identified on the document attached hereto as Exhibit C developed and agreed to by both VCDSA and Sheriffs’ Management, shall receive an assignment pay equal to five percent (5%) of base salary. Eligible employees excluded from shall receive the overtime provisions appropriate assignment pay per biweekly pay period, not to exceed eighty (80) compensated hours per pay period. The Sheriff retains the right to designate which assignments receive this assignment pay. The Sheriff also may reassign any employee receiving such assignment pay to any other assignment, including an assignment resulting in a loss of these Articles are also excluded from some or all of the provisions assignment pay. 2. Eight (8) hour shifts - When required to work five-eighths (5/8) of any shift between 3:00 p.m. and 11:00 p.m. employees shall be paid seven and one-half (7.5%) in addition to the employee's base pay/salary for all hours worked in the evening shift.
B. Night Pay
1. Twelve (12) hour shifts - When required to work seven- twelfths (7/12) of any shift between 7:00 p.m. and 7:00 a.m. employees shall be paid fifteen percent (15%) in addition to the employee's base pay/salary for all hours worked in the night shift.

A. An Evening Shift differential premium payment of seven and one-half percent (7.5%) of an employee’s base pay/wage shall be paid for each hour worked between 3:00 p.m. and 11:00 p.m.
B. Employees who work fifty percent (50%) or more of their shift during the Evening Shift shall receive the Evening Shift differential premium payment for their entire shift.
C. A Night Shift differential premium payment of fifteen percent (15%) of an employee’s base pay/wage shall be paid for each hour worked between 11:00 p.m. and 7:00 a.m.
D. Employees who work fifty percent (50%) or more of their shift during the Night Shift shall receive the Night Shift differential premium payment for their entire shift.
E. Scheduled 8-hours shifts, 9/80 schedules, or similar shifts occurring Monday thru Friday and beginning and completed between 6:00 a.m. and 7:00 p.m. shall not be eligible for any shift differential to ensure that employees working a typical County business week schedule are not eligible to receive a shift differential premium payment.

The allocation of positions among the respective levels shall be made by the Agency/Department Head, based upon the criteria established by, and subject to approval by, the Director-Human Resources DirectorResources. The level of an employee’s 's bilingual proficiency shall be determined by an examination administered by the Director-Human Resources DirectorResources. Employees assigned to such positions shall be eligible for bilingual premium pay at the level of required by their position or the level of their proficiency, whichever is less, subject to the conditions set forth herein. Such premium pay shall be in addition to their base pay. To be eligible to receive this premium pay, upon the recommendation of the Agency/Department Head and the Director-Human Resources DirectorResources, the County Administrative Executive Officer must designate that such payment will be made. In order to maintain eligibility for any level of premium pay, every eighteen (18) months, an employee must re-certify his/her proficiency in the two (2) languages upon which the bilingual premium is based by passing the related test(s) conducted by/through County Human Resources. Sec. 602 STANDBY PREMIUM PAY: Should an employee be placed on formal standby duty, such an employee shall be compensated for actual time on call at one-quarter (1/4) of his regular hourly salary or at minimum wagerate of pay, whichever is greaterand, and subject to application of the Fair Labor Standards Act, for time worked as a result of a callback to duty at his hourly wage when funds for such purposes have been specifically appropriated by the Board after specific inclusion in the department budgetrate of pay. In no instance shall a callback to duty be considered as less than two (2) hours for pay purposes. No employee shall be paid for call back callback time and standby simultaneously. All Sec. 603 ASSIGNMENT PAY: Effective July 30, 2006, all VCDSA members assigned to the Sheriffs’ Major Crimes Unit, as identified on the document attached hereto as Exhibit B developed and agreed to by both VCDSA and Sheriffs’ Management, shall receive an assignment pay equal to seven and one half percent (7.5%) of base salary. Effective July 1, 2007 all VCDSA members, whose primary function is investigations, as identified on the document attached hereto as Exhibit C developed and agreed to by both VCDSA and Sheriffs’ Management, shall receive an assignment pay equal to five percent (5%) of base salary. Eligible employees excluded from shall receive the overtime provisions appropriate assignment pay per biweekly pay period, not to exceed eighty (80) compensated hours per pay period. The Sheriff retains the right to designate which assignments receive this assignment pay. The Sheriff also may reassign any employee receiving such assignment pay to any other assignment, including an assignment resulting in a loss of these Articles are also excluded from some or all of the provisions assignment pay. Such reassignment shall not be considered a violation of this Sectionagreement or an infringement of any property right of the reassigned employee. VCDSA and Sheriffs’ Management agree to jointly reexamine the assignments eligible for assignment pay upon the request of either party.

Employees receiving Level II premium pay may voluntarily elect to take the Level I “oral only” qualification exam offered by the Sheriff’s Office in lieu of requalifying for the Level II premium. Should such employee pass the Level I examination, the premium pay for Level 1 shall be effective the next full pay period following the results of the examination. Any employees who fail to qualify at their current level of bilingual proficiency shall no longer be eligible for bilingual premium pay until they pass a subsequent qualification examination. Employees who have passed the County Level III exam are exempted from the requalification requirements. FOR ALL EMPLOYEES NOT RECEIVING BILINGUAL PREMIUM PAY AND FOR ALL EMPLOYEES WHO FAIL TO PASS A REQUALIFICATION EXAM TO MAINTAIN ELIGIBILITY FOR THEIR CURRENT LEVEL OF BILINGUAL PAY: Such employees may take a qualification examination through either the (a) or (b) option described above for the level of their proficiencyproficiency for Bilingual Levels I, whichever is lessII or III. Eligible employees shall receive the appropriate assignment pay per biweekly pay period, not to exceed eighty (80) compensated hours per pay period. The Sheriff retains the right to designate which assignments receive this assignment pay.
