Previously Obtained or Distributed Covered Products. 3.2.1 Sur La Table certifies as a material term of this Agreement that it has taken careful steps to make sure that all existing inventory of Covered Products in, or to be sold in, its California retail stores have been labelled with a Proposition 65 clear and reasonable warning. Should Sur La Table discover that its interim labelling efforts have not resulted in the placement of interim Proposition 65 warnings on existing California inventory of Covered Products, then, within ten (10) days of such discovery, Sur La Table shall send a letter, electronic or otherwise (“Notification Letter”) to the manager of each California retail store and each distribution center providing Covered Products to its California retail stores. The Notification Letter shall advise each such manager that the Covered Products “contain Lead, a chemical known to the State of California to cause cancer and birth defects or other reproductive harm” and that all Covered Products must be labelled with a clear and reasonable Proposition 65 warning before it is sold in the California market.

Previously Obtained or Distributed Covered Products. This section 3.2 applies to any Covered Product manufactured, purchased or otherwise obtained by Kent prior to March 15, 2013, and which Covered Product has not been confirmed to be DEHP Free by independent laboratory testing or certified to be DEHP Free by the manufacturer of the product (“Previously Obtained Covered Product”). Product Warnings Commencing on the Effective Date, Kent shall not sell or ship any Previously Obtained Covered Products to a vendor or retailer, unless such Previously Obtained Covered Products are sold or shipped with one of the clear and reasonable warnings set forth hereafter, such warnings having been drafted and supplied by Xxxxxx who warrants that they meet or exceed the Proposition 65 warning requirements for this DEHP product. Each warning shall be prominently placed with such conspicuousness as compared with other words, statements, designs, or devices as to render it likely to be read and understood by an ordinary individual under customary conditions before purchase or use. Each warning shall be provided in a manner such that the consumer or user understands to which specific Previously Obtained Covered Product the warning applies, so as to minimize the risk of consumer confusion.
Previously Obtained or Distributed Covered Products. 3.2.1 Customer Notification - no later than the Effective Date, Xxxxxxxxx shall send a letter, electronic or otherwise (“Notification Letter”) to: (1) each customer to whom it, after January 1, 2018, supplied any Covered Product or Unique Covered Product and for which customer Xxxxxxxxx maintains an associated address. The Notification Letter shall advise the recipient that the brass components of each Covered Product and Unique Covered Product contain Lead, a chemical known to the State of California to cause birth defects and other reproductive harm. The Notification Letter shall list each specific Covered Product and Unique Covered Product, by store description, size and any store identification number that are the subject of the warning advice. The Notification letter shall offer to accept return of any Covered Product or Unique Covered Product in exchange for a full refund.‌‌‌‌
Previously Obtained or Distributed Covered Products. 3.2.1 Godinger represents as a material term of this Agreement that all its old inventory of Covered Products not made Lead Free by its new vendor was exhausted by September 30, 2016 and that all Covered Products distributed by Godinger since that date and currently meet the Lead Free standard. As such, conditioned upon the accuracy of this representation, Godinger shall have no obligation to implement interim Covered Product customer or product warning efforts. Should Godinger discover any inventory of Covered Products that is not Lead Free, then Godinger shall not sell or ship such Covered Product to a California retailer, or sell or ship any such Covered Product to a vendor or retailer that Godinger reasonably understands maintains retail outlets in California, unless such Covered Product is labeled with the following clear and reasonable warning: WARNING: This product contains Lead, a chemical known to the State of California to cause birth defects or other reproductive harm.   • Unbundled Copper Loop – Designed (UCL-D) 2.4.2.1 The UCL-D will be provisioned as a dry copper twisted pair (2- or 4-wire) Loop that is unencumbered by any intervening equipment (e.g., filters, load coils, range extenders, digital loop carrier, or repeaters).

  • Unbundled Sub-Loop Distribution Intrabuilding Network Cable (USLD-INC) is the distribution facility owned or controlled by BellSouth inside a building or between buildings on the same property that is not separated by a public street or road. USLD-INC includes the facility from the cross connect device in the building equipment room up to and including the point of demarcation at the End User’s premises.

  • Unbundled Subloop Distribution (USLD) 2.8.2.1 The USLD facility is a dedicated transmission facility that BellSouth provides from an End User’s point of demarcation to a BellSouth cross-connect device. The BellSouth cross-connect device may be located within a remote terminal (RT) or a stand-alone cross-box in the field or in the equipment room of a building. The USLD media is a copper twisted pair that can be provisioned as a 2-wire or 4-wire facility. BellSouth will make available the following subloop distribution offerings where facilities exist: USLD – Voice Grade (USLD-VG) Unbundled Copper Subloop (UCSL) USLD – Intrabuilding Network Cable (USLD-INC (aka riser cable))

  • Unbundled Copper Loop – Non-Designed (UCL-ND 2.4.3.1 The UCL–ND is provisioned as a dedicated 2-wire metallic transmission facility from BellSouth’s Main Distribution Frame (MDF) to a customer’s premises (including the NID). The UCL-ND will be a “dry copper” facility in that it will not have any intervening equipment such as load coils, repeaters, or digital access main lines (DAMLs), and may have up to 6,000 feet of bridged tap between the End User’s premises and the serving wire center. The UCL-ND typically will be 1300 Ohms resistance and in most cases will not exceed 18,000 feet in length, although the UCL-ND will not have a specific length limitation. For Loops less than 18,000 feet and with less than 1300 Ohms resistance, the Loop will provide a voice grade transmission channel suitable for Loop start signaling and the transport of analog voice grade signals. The UCL-ND will not be designed and will not be provisioned with either a DLR or a test point.

  • Shared Transport The Shared Transport Network Element (“Shared Transport”) provides the collective interoffice transmission facilities shared by various Carriers (including Qwest) between end-office switches and between end-office switches and local tandem switches within the Local Calling Area. Shared Transport uses the existing routing tables resident in Qwest switches to carry the End User Customer’s originating and terminating local/extended area service interoffice Local traffic on the Qwest interoffice message trunk network. CLEC traffic will be carried on the same transmission facilities between end- office switches, between end-office switches and tandem switches and between tandem switches on the same network facilities that Qwest uses for its own traffic. Shared Transport does not include use of tandem switches or transport between tandem switches and end-office switches for Local Calls that originate from end users served by non- Qwest Telecommunications Carriers (“Carrier(s)”) which terminate to QLSP End Users.

  • Interconnection Product Options Interconnection Customer has selected the following (checked) type of Interconnection Service:

  • Coronavirus-Related Distributions (CRDs If you qualify, you may withdraw up to $100,000 in aggregate from your IRAs and eligible retirement plans as a CRD, without paying the 10 percent early distribution penalty tax. You are a qualified individual if you (or your spouse or dependent) is diagnosed with the COVID-19 disease or the SARS-CoV-2 virus in an approved test; or if you have experienced adverse financial consequences as a result of being quarantined, being furloughed or laid off or having work hours reduced due to such virus or disease, being unable to work due to lack of child care due to such virus or disease, closing or reduced hours of a business owned or operated by you due to such virus or disease, or other factors as determined by the IRS. A CRD must be made on or after January 1, 2020, and before December 31, 2020. CRDs will be taxed ratably over a three-year period, unless you elect otherwise, and may be repaid over three years beginning with the day following the day a CRD is made. Repayments may be made to an eligible retirement plan or IRA. An eligible retirement plan is defined as a qualified retirement plan, 403(a) annuity, 403(b) tax-sheltered annuity, 457(b) eligible governmental deferred compensation plan, or an IRA.   • Loop Provisioning Involving Integrated Digital Loop Carriers 2.6.1 Where InterGlobe has requested an Unbundled Loop and BellSouth uses IDLC systems to provide the local service to the End User and BellSouth has a suitable alternate facility available, BellSouth will make such alternative facilities available to InterGlobe. If a suitable alternative facility is not available, then to the extent it is technically feasible, BellSouth will implement one of the following alternative arrangements for InterGlobe (e.g. hairpinning):
