Non-Monetary Relief. The Agency agrees to provide non-monetary relief, which includes remedial and prospective relief, as identified below. If there are any material deviations from the non-monetary relief provisions below that require alternative methods and means of relief or extensions of time due to infeasibility, USMS shall notify Class Counsel and provide written justification of its need to make material alterations from the terms outlined below and the Parties shall seek to reach agreement on the alternative method and means through the dispute resolution procedures set forth in Section VIII of this Settlement Agreement. Infeasibility includes, but is not limited to a lapse in appropriations (e.g., a government shutdown), relief requiring legislative, contractual or procurement approvals beyond DOJ or Agency control or authority, changes in statutory or regulatory law, Executive Orders, DOJ or Agency policies, guidance, and directives, as well as events beyond DOJ or Agency control such as natural disasters (e.g., hurricanes, tornadoes, and earthquakes, as well as human actions), armed conflict, and public health emergencies (e.g., a pandemic or man-made diseases). The Agency shall be responsible for the administration and implementation of the non- monetary relief provided herein, except for any expenses related to the Claims Administrator and Claims Allocator. The class of individuals covered by this Settlement are limited to and specifically enumerated in Section II(D), (F), and (G) as Class Agents, Class Members or Claimants. Accordingly, all remedies referenced are limited to the class of individuals covered by this Settlement.

Non-Monetary Relief. BRSI has taken the following measures after discovering the Data Breach: • BRSI changed all user credentials and disabled remote access to its environment. • BRSI installed Carbon Black, an Endpoint Detection and Response tool to monitor its environment for malicious activity. This tool reports to Red Canary’s 24/7 monitoring and mitigation software. • BRSI enabled Multi-Factor Authentication (“MFA”) for all BRSI users logging into the corporate environment, whether internal or external. • BRSI worked to implement data encryption policies to ensure that all client data maintained on the BRSI network is stored in an encrypted format pursuant to AES 256. • BRSI took and continues to take measures to implement more frequent and focused training programs for employees on topics such as phishing emails and security awareness. This includes additional employee phishing testing approximately every two weeks, as well as providing weekly tips and a monthly newsletter reinforcing appropriate cyber hygiene. The phishing training includes but is not limited to: o Social engineering red flags and attack tactics o Hardware and software threats o Pretexting: maintaining cyber hygiene o Email red flags: Phishing, spear-phishing o Telephone attacks: Vishing o Mobile device security Internet security: disinformation, social media, online threats • BRSI implemented McAfee MVISION, which offers threat detection, compliance, and security incident management through the gathering and analysis of real-time and historical security event data and sources. It also protects against data loss by identifying and securing data within BRSI’s network and offline.
Non-Monetary Relief. 64. As further consideration to the Plaintiff and Settlement Class Members for entering into this Agreement, MG Billing Limited agrees that, from the Effective Date of this Agreement, it will not offer a Premium Subscription for sale simultaneously with a Brazzers Subscription. MG Billing Limited acknowledges, for purposes of this Settlement only, that simultaneously offering a Premium Subscription while offering the Brazzers Subscription is a material claim according to Plaintiff in this Action. MG Billing Limited agrees that this practice change will save Settlement Class Members and future consumers millions of dollars.
Non-Monetary Relief. All Settlement Class Members, including those who do not submit a Claim Form, have the right under the Settlement to request a free copy of their consumer report from Credit Plus. Requests may be made on the Settlement Website through a web form, which allows the Settlement Class Member to upload their ID, or through a mailed written request to Credit Plus, using the form attached to the Long Form Notice (Exhibit B). Settlement Class Members electing to request the copy of the consumer report referenced above through either a web form or paper form must follow the instructions listed on the respective form. Requests must be accompanied by a copy of government-issued photo identification and include the Settlement Class Member’s name, last four digits of their social security number, the address where the report should be sent, telephone number, email address (if applicable), and signature. If a mailed request does not utilize the form provided, it must also include a statement to the effect that “Pursuant to the Settlement in Pang v. Credit Plus, Inc., I am requesting a copy of my consumer report.”
