Procedures for RIF of Post-Probationary Teachers. In the event that further staff reduction that will include post-probationary teachers is necessary then, after considering the District's unique educational or instructional needs, staff reduction shall comply with the terms of NRS 288.151. If after complying with NRS 288.151 an additional reduction in the workforce is required, the additional reduction will be based on teacher seniority. Seniority is as defined in Article 20.5, shall determine the order in which remaining teaching staff will be reduced. However, no teacher qualified to teach a particular assignment or grade level as evidenced by a current valid certificate by the Nevada State Board of Education shall be replaced by another teacher not qualified for such assignment. The unique educational or instructional needs of the District may include, without limitation, a consideration of the following factors: 1. Whether the teacher is employed in a position which is hard to fill; 2. The type of licensure or type of degree attained by the teacher; 3. Endorsements or certifications attained by the teacher; 4. Trainings or skill sets that a teacher possesses that meet unique or program needs of the District.

If the Board of Trustees of a school district determines that a reduction in the existing workforce of the licensed educational personnel in the school district is necessary, the decision to lay off a teacher must not be based solely on the seniority of the teacher and may include without limitation, a consideration of the following factors: 1. Whether the teacher or administrator is employed in a position which is hard to fill; 2. Whether the teacher or administrator has received a national board certification; 3. The performance evaluations of the teacher or administrator; 4. The disciplinary record of the teacher or administrator within the school district; 5. The criminal record of the teacher or administrator , if any; 6. The type of licensure held by the teacher or administrator; and 7. The type of degree attained by the teacher or administrator and whether the degree is in a subject area that is related to his or her position.
Procedures for RIF of Post-Probationary Teachers. Lander County Classroom TeachersAssociation Contract with Lander County School District July 1, 2023 – June 30, 2025 In the event that further staff reduction is necessary and a teacher’s seniority as defined by NRS 288.151 becomes a factor in the District’s decision determining the order in which remaining teaching staff will be reduced. The Board will determine seniority based on the number of years of service commencing with the first day of the semester in which a teacher begins working for Lander County School District. Teacher(s) commencing work after the beginning of the semester shall be credited with proportionally less seniority, as determined by the actual date the Teacher(s) began work subsequent to the beginning of the semester. In the event two or more Teachers have the same semester seniority, Teacher(s) commencing work after the beginning of the semester shall be credited with proportionately less seniority, as determined by the actual date the Teacher(s) began work subsequent to the beginning of the semester.

The following shall apply to employees providing instruction in adult education programs in these districts: Continuing Education employees in the Adult Education High School Completion Program (credit courses) and Adult Education Academic Upgrading Programs (Adult Basic Education, General Education Development, Pre-General Education Development, Literacy and Adult Education English Language Programs). Employees teaching Adult Education academic programs including: High School Completion Program, Pathfinder High School Completion Program, Academic Business Education Program, General Equivalency Diploma Program, Adult Basic Education Program, Adult English as a Second Language Program, and Adult Special Education Program, in the Continuing Education Division.

  • Employment of Apprentices 1. Where either the prime AGREEMENT or the subagreement exceeds thirty thousand dollars ($30,000), the CONSULTANT and any subconsultants under him or her shall comply with all applicable requirements of Labor Code §§ 1777.5, 1777.6 and 1777.7 in the employment of apprentices. 2. CONSULTANTs and subconsultants are required to comply with all Labor Code requirements regarding the employment of apprentices, including mandatory ratios of journey level to apprentice workers.   • Termination Procedures and Compensation During Dispute 7.1. After a Change in Control and during the term of this Agreement, any purported termination of the Executive's employment (other than by reason of death) shall be communicated by written Notice of Termination from one party hereto to the other party hereto in accordance with Section 10 hereof. For purposes of this Agreement, a "Notice of Termination" shall mean a notice which shall indicate the specific termination provision in this Agreement relied upon and shall set forth in reasonable detail the facts and circumstances claimed to provide a basis for termination of the Executive's employment under the provision so indicated.   • Continuity of Services A. The Contractor recognizes that the service(s) to be performed under this Contract are vital to the State and must be continued without interruption and that, upon Contract expiration, a successor, either the State or another contractor, may continue them. The Contractor agrees to: Furnish phase-in training; and Exercise its best efforts and cooperation to effect an orderly and efficient transition to a successor. B. The Contractor shall, upon the State's written notice: Furnish phase-in, phase-out services for up to sixty (60) days after this Contract expires; and Negotiate in good faith a plan with a successor to determine the nature and extent of phase-in, phase-out services required. The plan shall specify a training program and a date for transferring responsibilities for each division of work described in the plan, and shall be subject to the State's approval. The Contractor shall provide sufficient experienced personnel during the phase-in, phase-out period to ensure that the services called for by this Contract are maintained at the required level of proficiency. C. The Contractor shall allow as many personnel as practicable to remain on the job to help the successor maintain the continuity and consistency of the services required by this Contract. The Contractor also shall disclose necessary personnel records and allow the successor to conduct on-site interviews with these employees. If selected employees are agreeable to the change, the Contractor shall release them at a mutually agreeable date and negotiate transfer of their earned fringe benefits to the successor. D. The Contractor shall be reimbursed for all reasonable phase-in, phase-out costs (i.e., costs incurred within the agreed period after contract expiration that result from phase-in, phase-out operations).
