BUY AMERICAN IRON AND STEEL: For Orders in which iron or steel products will be used, Contracting Party agrees to comply with Section 2252.202, Texas Government Code, requiring any iron or steel products produced through manufacturing process and used in the projects be produced in the United States, unless otherwise exempt under Section 2252.203, Texas Government Code. STATE AUDITOR’S OFFICE: Contracting Party understands that acceptance of funds under the Agreement constitutes acceptance of the authority of the Texas State Auditor's Office, or any successor agency (collectively, “Auditor”), to conduct an audit or investigation in connection with those funds pursuant to Sections 51.9335(c), Texas Education Code. Contracting Party agrees to cooperate with the Auditor in the conduct of the audit or investigation, including without limitation providing all records requested. NONDISCRIMINATION: Contracting Party shall comply with Federal and State of Texas civil rights laws and University policies prohibiting discrimination and harassment. Contracting Party shall not discriminate against an employee or applicant for employment with respect to the hire, tenure, terms, conditions, or privileges of employment, or any matter directly or indirectly related to employment, because of race, color, religion, gender, national origin, age, sexual orientation, veteran status, or disability that is unrelated to the individual’s ability to perform the duties of a particular position. TEXAS HAZARD COMMUNICATION ACT: Contractor is familiar and in full compliance with the Texas Hazard Communication Act (Texas Health and Safety Code Chapter 502), and will provide either (i) a Material Safety Data Sheet (“MSDS”) for each product Contractor, its employees, agents or subcontractors brings on LIT’s premises, or (ii) a statement of exemption if the product is not covered by the Texas Hazard Communication Act. BEST VALUE PRICING: The price to be paid by LIT will be that contained in Contractor's quote, bid or proposal, which Contractor warrants to be no higher than Contractor's current prices on orders by others for goods or services of the kind covered by the Contract for similar quantities to similar customers under similar conditions. In the event Contractor breaches this warranty, the prices will be reduced to Contractor's current prices on orders by others or, in the alternative, LIT may cancel this Contract at its sole option without liability to Contractor.
