The Prohibition Against Supplanting clause prevents one party from replacing or substituting the agreed-upon goods, services, or obligations with alternatives not specified in the contract. When calculating the total amount of local EIS funds, do not include charitable contributions to non-profit agencies in the total amount of local funds.
Prohibition Against Supplanting. Contractor must not use any funds provided by the Commission to supplant existing funds in contravention of law or Commission policy. Contractor must use any monies leveraged, obtained through matching funds, part of governmental or private grant funds, or in any way resulting from the use of funds provided by the Commission, solely in performing the Services. Contractor’s use of these funds is subject to the Commission’s approval at the Commission’s sole discretion.
