PROMOTIONS AND LATERAL TRANSFERS. (1) Whenever a vacancy occurs in a department, the vacancy shall be posted (together with department and grade) for five (5) days. Preference for such vacancy shall be given to the employee within the department, who bids for the position (except where a laid off employee has recall rights), taking into account an employee's work record, experience, skill and ability to perform the required duties, and Affirmative Action considerations. Departmental seniority shall prevail where employees are equal based on the aforementioned factors. If the position cannot be filled from within the department, the same procedure shall be followed for filling the position from outside the department, except where such qualifications are equal, bargaining unit seniority shall prevail.
