Provisional Payments. If any royalty becomes due and payable to the Royalty Holder prior to the Payor’s final estimates of the total amount payable, then the Payor shall pay the Royalty Holder a provisional royalty payment using the Payor’s then current estimates of the amount payable for Products produced during the Calendar Quarter.
Provisional Payments. In the event that any Royalty becomes due and payable hereunder prior to final settlement with a smelter, refiner or other bona fide purchaser, or prior to TRC’s final determination, in accordance with Section 15.4, of all of the facts necessary to calculate the amount of Royalty payable to Owner with respect to commingled Minerals, then TRC shall pay to Owner a provisional Royalty based upon TRC's then current estimates of such facts and the preliminary settlement with the smelter, refiner or other bona fide purchaser. Payments of provisional Royalty shall be subject to subsequent adjustment in accordance with Section 6.3.C.
Provisional Payments. If Production Returns are received on a provisional basis, the Production Returns shall be calculated based on provisional payments received by or credited to the account of Owner at the time for payment and provisionally paid, and an adjustment shall be made on the next quarterly Royalty payment based upon final Production Returns for such Calculation Period.
Provisional Payments. Your statement will serve as notice of any ACH credits or debits to your Account, and you agree that we are not required to provide any other notice to you. Credit given by us to you with respect to an ACH credit entry is provisional until we receive final settlement for the transaction. If we do not receive final settlement, you agree that we are entitled to debit from your Account the amount credited to you in connection with the transaction, and the party making payment to you (the originator of the entry) shall not be deemed to have paid you in that amount.
Provisional Payments. In the event that final amounts required for the calculation of the NSR Royalty are not available within the time period referred to in Section 3 of this Schedule B, then provisional amounts will be estimated and the NSR Royalty paid on the basis of this provisional calculation. Positive or negative adjustments will be made to the NSR Royalty payment of the succeeding calendar quarter.
Provisional Payments. The provisional payments to be made to SkyWest pursuant to Section 5.02(b)(i), above, shall be calculated as follows for the applicable period:
(A) Each Provisional Block Hour Payment will be equal to the amount set forth on Exhibit 5.02(c)(i), as such amount may be changed from time to time during the term of this Agreement by mutual agreement of Midwest and SkyWest.
(B) Each Provisional Cycle Payment will be equal to the amount set forth on Exhibit 5.02(c)(i), as such amount may be changed from time to time during the term of this Agreement by mutual agreement of Midwest and SkyWest.
(C) Each Provisional Fixed Cost Payment will be equal to the amount set forth on Exhibit 5.02(c)(i), as such amount may be changed from time to time during the term of this Agreement by mutual agreement of Midwest and SkyWest.
(D) Each Provisional Monthly Margin Payment will be equal to [*].
Provisional Payments. County payments to Contractor for performance of eligible services hereunder are provisional until the completion of all settlement activities and audits, as such payments are subject to future County, State and/or Federal adjustments. County adjustments to provisional payments to Contractor may be based upon County’s claims processing information system data, Medi-Cal Administrative Activities (MAA) data base information, State adjudication of Medi-Cal and Healthy Families claims files, contractual limitations of this Agreement, annual cost report, application of various County, State and/or Federal reimbursement limitations, application of any County, State and/or Federal policies, procedures and regulations, and/or County, State or Federal audits, all of which take precedence over monthly claim reimbursements. County and Contractor acknowledge that the references in this paragraph represent examples only and are not intended, nor shall be construed, to represent all of the circumstances or conditions that may result in adjustments to provisional payments.
Provisional Payments. You agree to be bound by the provision of the NACHA rules making a payment to your creditor by the financial institution of your creditor (which may be the Bank if your creditor’s account is with us) provisional until you creditor’s financial institution receives final settlement for your payment from your account. If final settlement is not received, your creditor’s financial institution is entitled to a refund from your creditor of the amount credited. This means your creditor will not have been paid.
Provisional Payments. In the event that final amounts required for the calculation of the Net Smelter Returns Royalty are not available within the time period referred to in Section 5 of this Appendix C, then provisional amounts will be estimated and the Net Smelter Returns Royalty paid on the basis of this provisional calculation. Positive or negative adjustments will be made to the Net Smelter Returns Royalty payment of the succeeding calendar quarter.
Provisional Payments. Seller, if so requested by Buyer, shall have to make available to the Company the amounts to be paid by same on the basis of tax assessments or other fiscal orders or judicial or administrative decisions even when only provisionally enforceable, provided that the Company or Buyer shall reimburse Seller of the sums subsequently recovered by the Company or Buyer, net of any taxes at the charge of the Company or Buyer, if any, in connection with any Amount of Indemnification paid by Seller.
