During the Term hereof, User shall only be permitted to use the Unit for the purpose of storing property wholly owned by User and property permitted by the Rules adopted by the District governing the RV/Boat Storage Facility. A copy of the rules are attached hereto as Exhibit “A” and incorporated herein by reference. By signing this agreement, User represents that he or she has read Exhibit “A” and agrees to comply with the rules and policies set forth therein, as well as any amendments or additions thereto. User agrees not to store collectibles, heirlooms, jewelry, and works of art or any property having special or sentimental value to User. User waives any and all claims for emotional or sentimental attachments to the stored property. Nothing herein contained shall constitute any agreement or admission by District that User’s stored property has any value, nor shall anything alter the release of District’s liability set forth below. User acknowledges and agrees that District is not engaged in the business of storing goods for hire and no bailment is created under this Agreement. District exercises neither care, custody nor control over User’s stored property, and District shall have no duty to maintain any inventory or any other records of contents stored in the Unit.

The purpose of this License is to allow the LICENSEE to enter, occupy, and use the Premises to administer COVID–19 vaccines to the public and other purposes related thereto, subject to the terms, conditions, and restrictions set forth in this License. This License is personal to LICENSEE and does not grant the LICENSEE any ownership, leasehold, easement, or other real property interest or estate in the Premises or the Property. In no event shall the LICENSEE represent itself or its operations on the Premises as being a part of, affiliated with, or an agent or partner of, or in a joint venture with, any of the OWNER or any of their respective programs or operations.

ICQ shall not have any right under any circumstances, or authorize any third party (which, for avoidance of doubt, includes any Affiliate of ICQ), to (i) adapt the ICQ IP Telephony Software (other than adaptation in accordance with Section 10.1.1 or as otherwise authorized by the Source Code Escrow Agreement or license described in Section 10.2), (ii) reverse engineer, decompile, disassemble or otherwise attempt to reconstruct the source code for or underlying algorithms, processes or methods of the ICQ IP Telephony Software that is provided in object code form, or (iii) reproduce or distribute the ICQ IP Telephony Software to any third party (other than as expressly provided in this Agreement). All copies of the ICQ IP Telephony Software made hereunder shall include all proprietary notices included on the copy provided by N2P, and ICQ shall not remove, deface or obscure or authorize to be removed, defaced or obscured any of N2P's or its licensors' proprietary rights notices on or in the ICQ IP Telephony Software or on output generated by the software; provided that the placement of such notices, if any, in the ICQ IP Telephony Software that are visible in the user interface of such software shall be subject to ICQ's prior written approval, which approval will not be unreasonably withheld. ICQ agrees that any and all copies of the ICQ IP Telephony Software distributed to third parties shall be pursuant to binding license agreements no less restrictive or protective of N2P's rights than this Section 10.1. ICQ agrees that any material violation of this Section 10.1 by ICQ that is not cured by ICQ within thirty (30) days shall constitute a material breach of this Agreement. Purpose of License. The purpose of this Agreement is to provide a revocable license for the continued operations of automobile wheels storage and sales on the Premises. Tire storage is not allowed on the Premises due to flammable nature, which would require a fire suppression system. If Licensee desires to add tire storage and sales as Permitted Uses on the Premises, Licensee must submit a request to the Director, which must be approved in Director’s sole and absolute discretion before Licensee may pursue the necessary approvals and permits for such expanded use. Licensee must obtain all necessary approvals and permits from the City and all applicable entities required for such use. As part of the permit approval process, Licensee would be required to install the necessary fire suppression system in the Building and on the Premises, as well as complete any other required building improvements. All materials and work must be completed at Licensee’s sole cost and expense. All systems installed by Licensee for tire storage and sales use shall be considered part of the Building and the City’s property upon termination or expiration of the Agreement. If Licensee completes the requirements and obtains the necessary approvals and permits for tire storage and sales on the Premises, then the same shall become Permitted Uses as defined herein.

This License is granted for the purpose of allowing Licensee to install air quality monitoring equipment on the Licensed Area and thereby facilitating ambient air quality monitoring. Licensee shall not claim privileges or rights to use the Licensed Area beyond those granted in this License. CRMS does not grant, or otherwise create any interest in real property, Licensee an interest or estate of any kind or extent whatsoever in the Licensed Area by virtue of this License or Licensee’s use hereunder.

The Sequim Farmers’ Market shall only use the property for the establishment and operation of its public market between the hours of 6:00 a.m. and 9:00 p.m. on weekends and holidays, and as otherwise approved by the City.
