Purpose of privileges and immunities. (1) The privileges and immunities provided for in this Agreement are not designed to give to Staff Members or official visitors of the Offices personal advantage. They are granted solely to ensure that the Organization is able to perform its official activities unimpeded at all times and that the persons to whom they are accorded have complete independence. (2) The Organization shall waive immunity where it considers that such immunity would impede the normal course of justice and that it can be waived without prejudicing the interests of the Organization. (3) In all cases, the Organization engages to encourage its Staff Members to comply with their legal obligations.

(2) ICPO-Interpol shall provide suitable procedures for settling: a) disputes arising out of contracts or other disputes in private law to which ICPO-Interpol is party; b) disputes involving a staff member of the Academy, any official of ICPO- Interpol or officer of ICPO-Interpol who, by reason of his or her official situation, benefits from immunity, provided that such immunity has not been waived by the Secretary General. (3) ICPO-Interpol shall waive immunity where it considers that such immunity would impede the normal course of justice and that it can be waived without prejudicing the interests of ICPO-Interpol. (4) ICPO-Interpol agrees that, in the case of attachment, pursuant to a decision by the judicial or administrative authorities, of the salary, emoluments or indemnities owed by ICPO-Interpol to a staff member of the Academy, it shall follow the instructions of the authority concerned, unless within 14 business days of the date on which it is notified of said decision it informs the Austrian authorities that compliance would be prejudicial to the interests of ICPO- Interpol.

In the case of attachment, pursuant to a decision by the judicial authorities, of the salary, emoluments or indemnities owed by the Academy to a staff member of the Academy immunity is deemed to be waved, unless the Academy informs the Austrian authorities within 14 business days of the date on which it is notified of said decision that it does not waive its immunity.

The EPLO Director shall have the right and the duty to waive those privileges and immunities accorded to any official or expert in any case where they would impede the proper administration of justice and can be waived without prejudice to the purpose for which they are accorded.

The privileges and immunities accorded in this Agreement to Staff Members, Officials other than Staff Members and Experts other than Staff Members are provided solely to ensure in all circumstances the unimpeded functioning of the Supplementary Fund and the complete independence of the persons to whom they are accorded. 2. The Director has the right and the duty to waive such immunities (other than their own and those of members of their family forming part of their household) when they consider that such immunities are preventing the carrying out of justice and when it is possible to dispense with them without prejudicing the interests of the Supplementary Fund. In respect of the Director and members of their family forming part of their household, the Assembly may waive such immunities.
