PURPOSE OF THE FEE. If any employee does not become a member of the Association during any membership year which is covered in whole or in part this agreement, said employee will be required to pay a representation fee to the Association for that membership year. The purpose of this fee will be to offset the employee's per capita cost of services rendered by the Association as majority representative. The representation fee to be paid by nonmembers/fee-payers will be pursuant to the determination of an impartial arbitrator in accordance with the law.

If an employee, either a certificated or non-certificated employee of the Board in a position represented by the Association in the negotiating unit described in the Recognition Clause of this Agreement, does not become a member of the Association during any membership year which is covered in part or in whole by this Agreement, said employee will be required to pay a representation fee to the Association for that membership year. If no agreement for representation fees in lieu of dues by payroll deduction is reached during negotiations between the majority representative and the public employer, the majority representative may petition the Public Employment Relations Commission (“PERC”) to conduct an investigation , and if PERC determines that a majority of the negotiations unit employees are voluntary dues paying members of the majority representative and that the majority representative maintains a demand and return system as required by N.J.S.A. 34:13A-5.5(c) and 5.6, PERC shall order the representation fee in lieu of dues from the wages or salaries of the negotiations unit employees who are not members of the majority representative.
