Qualification as Affordable Housing. Developer shall use, manage and operate the Properties in accordance with the requirements of the NSP Program, the HOME Program, the CDBG program, including without limitation 24 CFR 92.252 so as to qualify the housing on the Properties as Affordable Housing.

Qualification as Affordable Housing. During the Period of Affordability, HOME-assisted rental units shall be managed in accordance with regulations published at 24 CFR 92 Subpart FProject Requirements. Affordability must be maintained using guidelines set in 24 CFR 24.292. Household income must be calculated in accordance with regulations published at 24 CFR Part 5, Subpart F.
Qualification as Affordable Housing. Rental Housing. HOME-Assisted Units must be occupied only by households that are eligible as low-income families or very-low income families, all as defined in 24 CFR §92.2, and must meet the requirements to qualify as affordable housing pursuant to 24 CFR §92.252, as provided herein (“Affordability Requirements”).
Qualification as Affordable Housing. Homeownership Housing. Each HOME- Assisted Unit must be sold to and occupied by households that are eligible as low- income families as defined in 24 CFR §92.2 and 24 CFR §92.217. Low-income families mean families whose annual incomes do not exceed 80 percent of the median income for the area, as determined by HUD, with adjustments for smaller and larger families and must meet the requirements to qualify as affordable homeownership housing pursuant to 24 CFR §92.254, as provided herein (“Affordability Requirements”). The Affordability Requirements as they pertain to the developer will be in the form of a deed of trust that will be recorded against the properties subjecting them to encumbrances totaling [total amount of HOME funds being provided for project]. The deed of trust shall be subordinate to construction financing, if applicable, and MDHA shall provide releases for individual properties when fee simple title is transferred to income-eligible homebuyers and developer has complied with all terms of this Agreement.
Qualification as Affordable Housing. LESSEE agrees to make the units available for occupancy by low- and moderate-income tenants, who meet the HUD definition of low and moderate income, below 80 percent of Area Median Income. LESSEE will submit the information on tenant income in the annual report referenced in section 3.08 (C).
