Qualifications of Exhibitor. FEG, in its sole discretion, determines whether a prospective exhibitor is eligible to participate in the Event. Eligibility is generally limited to persons or firms that supply products and services to the motion picture theatre industry. Applicants may be required to submit a description of the nature of their business and the items to be exhibited. FEG reserves the right to restrict or remove any exhibit that FEG, in its sole discretion, believes is objectionable or inappropriate.

Qualifications of Exhibitor. All Exhibitors must be current Commercial, Affiliate Commercial, or Service Provider Members of NAMM as of the date this Exhibit Space Application/Contract is submitted for consideration and throughout the Event Dates. * Certain exceptions to these qualifications may be made by the Association in its sole and absolute discretion. Exhibitor agrees to be bound by NAMM’s bylaws. NAMM, in its sole discretion, will determine whether a prospective Exhibitor is eligible to participate in the Event. Eligibility is generally limited to companies, firms or entities actively and legitimately engaged in the business of manufacturing, distributing or selling at wholesale merchandise, materials, services or supplies in the music products industry. Members and/or Exhibitors whose products or services involve used musical products (as opposed to the restoration of musical products to the value of similar new products) or entail the mere refurbishment of used products are not eligible to exhibit in the Event. Dues for Commercial and Affiliate Commercial Members are $195 annually. Service Provider Member dues are $600 annually. Upon Exhibitor’s submission of this Exhibit Space Ap- plication/Contract and the requisite Exhibit Space Cost deposit for Exhibit Space to NAMM, Exhibitor may not withdraw or cancel this Exhibit Space Application/Con- tract or reduce the amount of exhibit Space requested herein. Offers made by NAMM as to location of Exhibit Space are based on current policy and not a location guarantee. The actual amount and location of the Exhibit Space assigned to Exhibitor will be determined by NAMM, at its sole and absolute discretion, based on information provided in this Contract and applying the Exhibit Space Assignment procedures described in this Contract and on NAMM’s website. If Exhibitor objects to the assigned Exhibit Space, Exhibitor must contact NAMM’s authorized representative within 15 days of the date of NAMM’s acceptance of this Con- tract via confirmation letter. Upon such notification NAMM will attempt, in good faith, to resolve Exhibi- tor’s objection. However, this Exhibit Space Contract will be effective on the date of acceptance by NAMM via confirmation letter, any objection to Exhibit Space assignment notwithstanding. Qualifications of Exhibitor. Organizer, in its sole discretion, shall have the right to determine whether a prospective Exhibitor is eligible to participate in the Convention. Organizer may at its discretion require applicants, who have not previously exhibited at a prior Convention or similar event held by the Organizer, to submit a description of the nature of their business and the items they intend to exhibit. Failure to respond to Organizer’s request will result in the denial of the application. At any time prior to or during the Convention, Organizer reserves the right to restrict or remove any exhibit, which Organizer in its sole discretion determines to be objectionable, offensive, inappropriate or illegal. Adult or Obscene Material may not be displayed except to those persons eighteen (18) years of age and over. If Organizer removes or restricts an exhibit which Organizer considers to be objectionable, offensive, inappropriate, or illegal, then no refund will be due Exhibitor. A violation of this provision may result in the Exhibitor’s immediate expulsion from the Convention without recourse, and may also result in additional penalties including but not limited to the suspension of Exhibitor and/or membership privileges for any duration up to a life-time ban with the duration to be decided by the Organizer in its sole discretion. If Organizer removes or restricts an exhibit which Organizer considers to be objectionable, offensive, inappropriate, or illegal, then no refund will be due Exhibitor for the rental of the exhibit space.

Eligibility is generally limited to ASI listed Supplier members, who are in good standing with Show and current in payment of charges invoiced by Show. Show reserves the right to restrict or remove any exhibit which Show, in its sole discretion, believes is objectionable or inappropriate. Suppliers that are not listed with ASI and that are a distributor or affiliated with a distributor may not exhibit at Show. Except for first-time exhibitors or other exceptions noted in the Terms and Conditions, to exhibit at Show and receive ASI supplier member prices, the exhibitor must be an ASI supplier member in good standing at the time of application, as well as at the time the Show is held.

NEWBAY MEDIA reserves the right to restrict or remove any exhibit which they believe is objectionable or inappropriate. Assignment of Space Exhibit space shall be assigned by NEWBAY MEDIA in its sole discretion for the Event and for the Event Dates only. Any such assignment does not imply that similar space will be assigned for future Events. Management reserves the right to change the floor plan or to move an Exhibitor to another booth location prior to or during the Event.

Artists who require extra space may apply for a premium artist alley booth via the Artist Alley Application. Exhibitor agrees to pay non-member pricing for exhibit space if not a member of the Central Oregon Builders Association.

The exhibitors will have to ensure that all their products which are showcased during the event are the best quality products. In case if the exhibitor fails to comply with quality norms of their products showcased or if the exhibitor is found showcasing inferior products during the event, the organiser has the right to instruct the exhibitor to replace the product within 3-4 hours failing which, the organizer reserves the right to either remove the product or cease the stall. Also if the exhibitor uses this platform to showcases duplicate products, the organizer reserves the right to remove the products and can file legal complaint against the exhibitor.
