Qualifying Condition. The Parties agree that the Reflight Launch Option is exercisable only in the event of a Launch Failure due to the Falcon launch vehicle. Such a Launch Failure must constitute either delivery of the Payload to an orbit where it cannot reasonably be used for the intended mission, destruction of the Payload as a result of Falcon breakup, or substantial damage to the Payload due to launch loads that materially exceed those defined in the Interface Control Document.
Qualifying Condition. Company and Customer agree that the services under this 4th Amendment will be implemented using one CLLI at $1,217, a second CLLI at $1,217 and a third CLLI at $1,748 (final DS-3 configuration). Discounts:
Qualifying Condition. All DS-1 access circuits must be located in legacy-Company lit building to receive the free access. In lieu of any other rates and discounts, the Customer will pay a fixed monthly recurring charge of $2,000 and an installation charge of $0 for OC-3 Dedicated Access Service at 1 NPA/NXX location mutually agreed upon by the Customer and the Company.
Qualifying Condition. In order to receive these rates, Customer must maintain the Dedicated Access OC3 circuit and the OC48 circuit for a minimum of 36 months. In lieu of any other rates and discounts, Customer will pay a fixed monthly recurring per-circuit local loop charge ranging from $175.00 to $1,900.00 for DS1 and DS3 Access Service. Discounts:
Qualifying Condition. Qualifying conditions may include, but are not limited to, acts of God (including fire, flood, earthquake, storm, floods, hurricane, or other natural disaster); war; terrorist activities; governmental restrictions, sanctions, or embargos; strikes, lockouts, or other labor disputes; interruptions in power, Internet, or telephone service; or damage to our facilities, servers, or resources.
Qualifying Condition. The Customer’s DS3 (TDS 45) local loops must be less than 15 miles, otherwise the Company reserves the right to charge the Customer standard Guide rates. In lieu of any other rates and discounts, the Customer will be charged fixed monthly recurring per-circuit local loop charges ranging from $100 to $9,370 for DS-1, DS-3 and OC12 Access circuits at 5 CLLI codes mutually agreed upon by the Customer and the Company.
Qualifying Condition. The Customer must maintain DS-1 Access Service in a Company lit building at 1 NPA/NXX location mutually agreed upon by the Customer and the Company. If Customer fails to maintain DS-1 Access Service at the Company lit building, the Company reserves the right to charge the Customer standard rates for DS-1 Access Service. Classifications, Practices and Regulations: Underutilization Charges: If, in any Contract Year during the Initial Term, Customer’s Total Service Charges do not meet or exceed the AVC, then Customer shall pay: (a) all accrued but unpaid charges incurred under this Agreement; and (b) an “Underutilization Charge” in an amount equal to 25% of the difference between the AVC and the Customer’s Total Service Charges during that Contact Year. Extended Term Underutilization: If in any monthly billing period during the Extended Term, Customer’s Total Service Charges do not meet or exceed 1/12th of the AVC then Customer shall pay: (a) all accrued but unpaid usage and other charges incurred under this Agreement, and (b) an “Underutilization Charge” equal to 25% of the difference between 1/12th of the AVC and Customer’s Total Service Charges during such monthly billing period.
Qualifying Condition. Customer represents that it will only be ordering DS-1 access service at one address in Illinois. If Customer orders DS-1 access service that is located at an address other than the aforementioned address, Company reserves the right to increase the monthly recurring charge for the DS-1 access service via a subsequent amendment to the SOF.
Qualifying Condition. Customer represents that it will only be ordering DS-3 Type 3 access service at one address in Texas. If Customer orders DS-3 Type 3 access service that is located at an address other than the aforementioned address, Company reserves the right to increase the monthly recurring charge for the DS-3 Type 3 access service via a subsequent amendment to the SOF.
Qualifying Condition. Customer represents that it will only be ordering Type 1 OC-3 Access Service for one address in Washington. If Customer orders Type 1 OC-3 Access Service that is located at an address other than the aforementioned address, Company reserves the right to increase the monthly recurring charge for the Type 1 OC-3 Access Service via a subsequent amendment to the SOF. Company will waive the one-time installation charges for Type 1 OC-3 Access, Private IP Bundled Port Services and Private IP Gold CAR associated with the implementation of eligible Services within the 48 contiguous United States under the SOF. Customer will receive this waiver for the duration of the SOF. Xxxxx Xxxxxxx, monthly recurring charges, expedite charges, change charges, surcharges, any charges imposed by third parties (including access, egress, jack or wiring charges), taxes or tax-like surcharges, or other Governmental Charges will not be waived. In lieu of any other rates and discounts, the Customer will pay monthly recurring charges ranging from $975.00 to $1,527.00 for Type 3 DS-3 Access, DS-3 Private IP Bundled Port and 22.496 Mbps Gold CAR at 1 CLLI code mutually agreed upon by the Customer and the Company. The installation charges for Type 3 DS-3 Access are not applicable and the installation charges for DS-3 Private IP Bundled Port and 22.496 Mbps Gold CAR are waived. The minimum service term is 12 months. Qualifying Condition: Customer represents that it will only be ordering circuits for one address in Connecticut. If Customer orders circuits within this CLLI code that are located at addresses other than the aforementioned address, Company reserves the right to increase the monthly recurring charge for above Access Service via a subsequent amendment to the SOF.
