Common use of Rate and Method of Overtime Compensation Clause in Contracts

Rate and Method of Overtime Compensation. (FLSA) Non-Exempt Employees Compensation for overtime shall be for all hours worked in excess of forty (40) hours in a workweek including all absences with pay authorized by law. Compensation for overtime worked by employees in classifications listed in the Appendices attached hereto shall be in time off at the rate of one-and-one-half (1½) hours for each hour of overtime worked or in cash at one and one-half times (1½) the employee’s regular rate of pay, at the discretion of Management.
