Eligibility for Overtime Compensation. (a) Overtime compensation rates for all hours worked in excess of the workday and workweek identified below shall be as follows:
Eligibility for Overtime Compensation. Employees in overtime eligible positions will receive time and one-half (1-1/2) their regular hourly rate unless a determination has been made that the position is executive, professional or administrative as defined in the Fair Labor Standards Act. Employees in positions which have been determined to be executive, professional or administrative shall receive time off for authorized time worked in excess of eight (8) hours per day or forty (40) hours per week at the rate of one (1) hour off for one (1) hour of overtime worked. This time off shall be utilized within one (1) year of being earned or shall be lost.
a. For all employees except Distribution Center: Overtime assigned shall be distributed among qualified employees customarily performing the kind of work required. The assignment of overtime shall first be offered on a voluntary basis by classification to qualified employees in Agency seniority order by either field office or central office, whichever is appropriate. Where there are no volunteers to meet staffing needs, the Agency shall select and assign qualified employees to work the overtime beginning with the least senior qualified employee and rotating thereafter.

Such time and one-half (1 ½) compensation shall be in the form of cash or compensatory time, pursuant to Articles 32.1-32.5. In Agencies where there is no contractual limitation on the accumulation of compensatory time the Employer may:
(1) schedule unilaterally up to forty (40) hours of unused compensatory time per employee per fiscal year, after prior notice of at least five (5) working days to the affected employees; and/or
(2) pay off in cash some or all of an employee’s unused compensatory time once per fiscal year.
Eligibility for Overtime Compensation. Employees shall receive time and one-half (1 1/2) their regular hourly rate unless the position is executive, professional or technical as these words are defined by the Fair Labor Standards Act. If the position is determined to be professional, administrative or executive, compensation of overtime shall be received as comp time at one hour for every hour worked in excess of eight (8) or forty (40).
a. Any trained employee, regardless of classification, may volunteer for overtime and shall be placed on the appropriate volunteer or mandatory lists. Transferring employees shall be considered “in house” for overtime lists beginning with their first scheduled shift as long as the employee is trained. At no time shall an employee work more than seventeen (17) hours in any twenty-four (24) hour period unless there is an extreme emergency or the employee has requested because of a special event and the manager has approved. When overtime is needed to maintain staffing levels the following procedure shall be used:

Promotion is an employee’s reassignment to a position having a higher salary schedule. On the date of promotion the employee is entitled to the higher of: (1) the first step of the salary schedule for the new position class; (2) advancement to the step of the new salary schedule which equals one step (approximately 4 percent) more than the previous salary.

Employees currently working in or assigned to one of the three inspection and regulatory program areas – Liquor, Recreational Marijuana, or Medical Marijuana – are not considered to be performing the kind of work required of employees in the other two program areas. As such, an employee working in or assigned to one program area will not be eligible for overtime opportunities in the other two program areas, regardless of seniority, classification, or qualification.

E mployees in cl asses assigned to pay g rades 5 t hrough 22 shall receive overtime compensation at the rate of one and one -half (1-1/2) times the regular hourly rate for all hours worked in excess of eight (8) in any workday or eighty (80) in a two (2) work week per iod. E mployees in cl asses assigned to pay g rade 22 sh all r eceive ov ertime compensation in the form of cash or compensatory time off, solely at Management’s discretion.
(3) Overtime Category 13. Employees in t he classes listed below sh all r eceive twenty percent (20%) of their base weekly salary per week irrespective of the maximum of their pay grades as full compensation for all overtime hours.
(4) Overtime Category 14. E mployees in cl asses assigned t o pay g rades above 21 w ho ar e covered by the provisions of the Fair Labor Standards Act, and who have not previously been in a “time-and-one-half” overtime category, shall receive overtime compensation at the rate of one and one-half (1-1/2) times their regular hourly rate for all hours worked in excess of forty (40) in any work week.
(5) Overtime C ategory 17. E mployees in cl asses assigned t o pay g rade 23 shall receive compensatory time off at straight time rates for all hours worked in excess of eight (8) in any workday or forty (40) in any workweek, or eighty (80) in a two (2) workweek period. Solely at management’s option, such overtime work may be compensated at straight time rates in cash.
(6) Overtime Category 18. Employees in classes assigned to pay grades 24 or above may be eligible to r eceive di scretionary co mpensatory t ime o ff f or ov ertime hour s worked. S olely at management’s option, such compensatory time may be compensated at straight time rates in cash.
