RECOGNITION CLAUSE. The Associations and the Employers it represents in bargaining recognizes Plumbers Local Union 130 UA (the “Union”) as the sole and exclusive bargaining representative for all of their employees who perform any of the work applicable within the Articles of Jurisdiction as set forth in "Appendix A" to this Agreement for which the Union has been chartered by the United Association within the City of Chicago, Illinois, Bureau, Xxxx, DeKalb, DuPage, Grundy, Iroquois, Xxxx, Kankakee, Kendall, Lake, LaSalle, Livingston, Marshall, McHenry, Putnam, Will and Woodford counties, Illinois and wherever additional geographic and territorial jurisdiction may be awarded by the United Association. . The Union recognizes the PCA as the exclusive bargaining agent of its individual member Employers with respect to their employees. Employees covered by this Agreement shall place in position and connect all materials, appurtenances, devices, fixtures and equipment used in the construction of plumbing as well as handle, unload and distribute all of the above mentioned upon and after its arrival on the job site or premises. When fixtures or equipment are protected by covering during construction, such covering shall be put on and removed and fixtures cleaned by employees covered by this Agreement. Employees covered by this Agreement shall do all the laying out, cutting and drilling of all holes, chases and channels, the setting and erection of bolts, inserts, stands, brackets, supports, sleeves, thimbles, hangers, conduits and boxes used in connection with work falling under the jurisdiction of the Union. It is understood and agreed that the foregoing Paragraphs of this Section shall not be construed as limiting the scope of bargaining unit work and that employees covered by this Agreement shall perform all work covered by the Articles of Jurisdiction included in Appendix A which comes within the work jurisdiction for which the Union has been chartered by the United Association.

RECOGNITION CLAUSE. The Associations Employer acknowledges that the Union has offered to establish its majority status by allowing the employer to examine authorization cards voluntarily executed by the employers eligible employees in the unit described in the CBA. The employer is satisfied that the Union has the support of a majority of the eligible employees in the appropriate unit to represent said employees for the purposes of collective bargaining and, further, the employer waives the opportunity to examine the authorization cards; and therefore, the Employers it represents in bargaining employer recognizes Plumbers Local pursuant to Section 9 (A) of the National Labor Relations Act, the Union 130 UA (the “Union”) as the sole and exclusive bargaining representative for all of their employees who perform any of the employees employed in the bargaining unit described. All work applicable within described and covered by Section 6 of the Articles I.U.P.A.T. Constitution, as outlined in Article III, Section 2 of Jurisdiction as set forth in "Appendix A" to this Agreement for which Agreement. The employer agrees that the Union has been chartered designated or selected for the purposes of Collective Bargaining by the United majority of the employees in an appropriate unit, that said majority support has been demonstrated and that the Union is the exclusive representative of all employees in such a unit for the purposes of Collective Bargaining in respect to rates of pay, wages, hours of employment or other conditions of employment. Painters District Council #4 recognizes the Construction Employers Association within of Central New York, The Painting and Decorating Contractors of Buffalo, New York, The Painters, Decorators and Contractors Association of Rochester, New York, as the City Representative of Chicago, Illinois, Bureau, Xxxx, DeKalb, DuPage, Grundy, Iroquois, Xxxx, Kankakee, Kendall, Lake, LaSalle, Livingston, Marshall, McHenry, Putnam, Will its members and Woodford counties, Illinois and wherever additional geographic and territorial jurisdiction may be awarded by the United Association. any individual contractor who designates such organization as their Representative. The Union recognizes the PCA Associations as authorized to act in collective bargaining negotiations for all the exclusive bargaining agent of its individual associations designated member Employers with respect to their employees. Employees covered The Associations are a third-party beneficiary of this Collective Bargaining Agreement, to the extent of the employer’s obligation to pay contributions for the Association Safety Program (ASP). The Associations represent that they are duly authorized by their designating members hiring DC4 union members to enter into this collective bargaining agreement, that in so doing they are authorized to bind such designating members to the terms and conditions of membership in said Associations, that such designating members shall continue to be bound by terms or, shall upon admission to the said Association, after the date of execution of this Agreement, agree to be bound from that date forward by all the terms and conditions of this Agreement. There shall be one (1) bargaining unit for all Employers bound by this Agreement shall place for the geographical and trade jurisdictions covered herein (for Regions 3, 6 and 7) as defined in position Article VI, Section 1) including any individual Employers who are not designated members of Construction Employers Association of Central New York, Inc. but who sign this Agreement or agree to be bound by it. It is understood and mutually agreed by both parties to this Agreement that the foregoing Paragraphs at no time shall any of these funds be used to support any anti-labor legislation, maintain a lawsuit against any local union of its International body or pay any salaries or expenses to any employee or Employer who is promoting non-union conditions or subsidize any contractor during a strike or lockout. All such CEA CNY contributions shall be remitted monthly to: CEA CNY Association Safety Program (ASP) 0000 Xxxxxxx Xxxx Syracuse, New York 13206 The Construction Employers Association of Central New York is a third-party beneficiary of this Section Collective Bargaining Agreement, to the extent of the Employer’s obligation to pay contributions to the Industry Advancement Fund. At the discretion of the Employers, Association Safety Program (ASP) rates may be changed. Any increases shall not be construed as limiting in addition to the scope previously agreed upon increases. At the discretion of bargaining unit work and that employees covered by this Agreement shall perform all work covered by the Articles of Jurisdiction included Associations, in Appendix A which comes within consultation with the work jurisdiction for which District Council BM/ST, the Union has been chartered by the United AssociationAssociation Safety Program (ASP) rates may be changed.

The Union recognizes the PCA as the exclusive bargaining agent of its individual member Employers with respect to their employees. The non-member signatories who become parties to this Agreement do hereby likewise recognize the Union as the Collective Bargaining Representative of all Employees of said Employer and as is covered by this Agreement shall do all Agreement. In as much as the laying outUnion has requested recognition from the employer as the exclusive bargaining representative of the employees in the bargaining unit described herein under Section 9(a) of the National Labor Relation Act, cutting and drilling has submitted proof thereof in the form of all holessigned and dated authorization cards, chases and channelsthe employer is satisfied that the Union represents a majority of its employees in the bargaining unit described herein, the setting employer hereby recognizes the Union as the exclusive collective bargaining Representative of its employees on all present and erection of bolts, inserts, stands, brackets, supports, sleeves, thimbles, hangers, conduits and boxes used in connection with work falling under future job sites within the jurisdiction of the Union, unless and until such time as the Union loses its status as the employees’ exclusive representative as a result of an NLRB election requested by the employees. It is understood and agreed The employer agrees that during the foregoing Paragraphs life of this agreement it will not request a NLRB election and expressly waives any right it may have to do so. Moreover, signatory Employers agree that if, in the future, a majority of their employees authorize the Union to represent them in collective bargaining, upon presentation of such evidence the Employer will recognize the Union as the NLRA Section shall not be construed 9(a) collective bargaining representative for all employees performing work within the jurisdiction of the Union on all present and future job sites. The Union hereby recognizes the Association as limiting the scope Collective Bargaining Agent and representative of bargaining unit work its present and that employees covered by future members and all non-members who are signatories to this Agreement as well as those independent employers who assign their bargaining rights to the Association during the term of this Agreement and any extensions thereof and for any other purposes that may be necessary for the administration of this Agreement. Insofar as the members of the Association are concerned, there shall perform be no limitations as to the terms of authority hereunder so long as those members remain members of the Association. The Associations is hereby authorized and empowered as the sole representative of all work covered by the Articles Employer Chapters to, or Signatories of Jurisdiction included in Appendix A which comes within the work jurisdiction for which the Union has been chartered by the United Associationthis Collective Bargaining Agreement to designate all Employer Representative and Employer Trustees on all Boards, Committees, and other Tribunals herein provided for.
