REEMPLOYMENT PROCEDURE. 1. Notwithstanding other provisions of this Agreement, any unit member who is employed in a position requiring certification qualifications, who are not entitled to termination rights under Education Code (hereinafter referred to as βE.C.β) Sections 44949 and 44955 shall be covered by the terms of this Article. a. The Superintendent shall notify a unit member prior to June 30 of the decision to reemploy or not to reemploy him/her for the succeeding school year. If reemployed the notice shall indicate the job assignment and anticipated terms of employment. A unit member who serves seventy-five (75) percent or more of the days of the school year in a satisfactory manner and who possesses an appropriate credential shall be reemployed in any open available position for the following school year. b. MCFSE shall be notified immediately upon the mailing of any notices of intent not to reemploy unit member(s). c. Upon request, the Superintendent/designee shall provide the unit member a written notice of the reasons for a reduction or termination of his/her services of employment for the following school year. d. A notice shall be deemed sufficient when it is either delivered in person to the employee to whom it is addressed, or when it is deposited in the United States certified mail, postage-prepaid and addressed to the last known address of the employee.
