Common use of Reinstatement from Leave Clause in Contracts

Reinstatement from Leave. Upon completion of a leave of absence, the employee is to be returned to the position formerly occupied, or to a similar position, if the employee's former position no longer exists. An approved leave of absence does not constitute a break in continuous service provided the employee follows the proper procedure for such leave and returns to active service immediately following the expiration of the approved leave. Any replacement in the position while the employee is on leave is to be on a temporary basis. An employee may be returned to work before the scheduled expiration of leave if requested by the employee and agreed to by the Employer. If an employee is unable to return to work at the scheduled expiration date of an approved leave, such inability to return must be substantiated by a medical excuse or similar written documentation, and the employee must make a written request to the Employer for extension of the leave, in accordance with Article 35. A request for an extension is not considered approved or denied until the employee receives a written response from the Employer.
