Relationship with Award. This Enterprise Agreement must be read and interpreted in conjunction with the Private Hospital Industry Nurses’ (State) Award.
Relationship with Award. 4.1 This Agreement must be read and interpreted in conjunction with the Private Hospital Industry Nurses’ (State) Award (“the Award”).
4.2 Except as provided for in this Agreement, the provisions of the Award will continue to apply to Employees employed by the Employer.
4.3 Should there be any inconsistency between any term of this Agreement and the Award then the terms of this Agreement will prevail.
Relationship with Award. This Clause shall be read in conjunction with the provisions of the Nurses (ANF – WA Public Sector) Award 1994 and shall prevail to the extent of any inconsistency.

Relationship with Award. (i) This Enterprise Agreement must be read and interpreted in conjunction with the Private Hospital Industry Nurses’ (State) Award.
(ii) Except as provided for in this Enterprise Agreement, the provisions of the Award will continue to apply to nurses employed by Dalcross Private Hospital.
(iii) Should there be any inconsistency between any term of this Enterprise Agreement and the Award then the terms of this Enterprise Agreement will prevail.
Relationship with Award. 1.4.1 This agreement will totally regulate the terms and conditions of employment and operates to the exclusion of any other Award, agreement or transitional instrument.
Relationship with Award. 4.1 The relevant awards for this Agreement are the Private Hospital Employees (State) Award and the Private Hospital Professional Employees (State) Award. Should there be any inconsistency between any term of this Enterprise Agreement and the Award then the terms of this Enterprise Agreement will prevail.
4.2 Subject to Clause 2.3, this Enterprise Agreement including its Schedules, regulates the terms and conditions of employment of non nursing employees at St Vincent’s Private Hospital (Lismore) (not including the St Joseph’s Aged Care Facility), to the exclusion of all other awards or agreements.
Relationship with Award. 6A.1 This Agreement is derived from the Metal, Engineering and Associated Industries Award 1998 (“Award”). The Award, as in operation just before this Agreement is made, is incorporated by reference into this Agreement, except for the following terms of the Award: 3.1.2, 3.2, 5.1, 7.1.6(b), 7.4.10(d), 7.5.3, 7.5.5 and Parts II, III, IV, V and VI.
6A.2 In incorporating Award terms by reference into this Agreement they are to be read as altered to incorporate necessary changes resulting from them being provisions of an agreement rather than provisions of an award. For example, the words “this award” would become “this agreement”. Moreover, the rates of pay and allowances provided for in this Agreement apply for purposes of the provisions in the incorporated Award.
6A.3 Where there is any inconsistency between a term in this Agreement and a term of an Award that has been incorporated by reference, the term in this Agreement shall take precedence to the extent of the inconsistency.
6A.4 A slightly modified version of the Award classification structure (which no longer operates as part of the Award and thus it may not be capable of being incorporated by this clause) is appended to this Agreement in Attachment “A”. This Attachment forms part of this Agreement, but where the attachment is inconsistent with the terms of the body of the Agreement, the terms in the body of the Agreement shall take precedence to the extent of the inconsistency.
Relationship with Award. As at the date of operation of this Agreement, to the extent that these terms pertain to the employment relationship between employer and their employees, shall be considered terms of this Agreement. Where there is any inconsistency between the terms of this Agreement and the terms of the Award as incorporated, the terms of this Agreement shall prevail to the extent of the inconsistency.
