Remedies for the Complainant. By May 31, 2017, the University will conduct an investigation into the complainant’s allegation that his XXXXX XXXXX course (the “course”) instructor for the spring 2016 semester (the “course instructor”) deducted points from and gave him a failing grade on his final paper in the course based on his sex, and ensure that the investigation complies with the regulation implementing Title IX. As part of the investigation, the University will review all information, including documentary evidence previously provided to the University by the complainant and the course instructor, and documentary evidence provided by the University to OCR; allow the parties an opportunity to provide additional information and witnesses; interview and/or re- interview witnesses, including the complainant and the course instructor, as appropriate; review additional information, as appropriate; prepare a report outlining the steps taken in the investigation; summarize the interviews completed; and determine, using a preponderance of the evidence standard, whether or not the complainant received a failing grade on the final paper for the course because of his sex. The outcome of the investigation will be communicated to the parties. If the University finds that sex discrimination occurred, the University will offer the complainant the opportunity to choose whether he wishes to retake the course, free of charge, or be reimbursed for the tuition he paid for the course. The University will provide the complainant thirty (30) calendar days to respond to such offer. In addition, the University will expunge from his record the F grade the complainant received for the course; and take any additional corrective actions, including disciplinary action against the course instructor, if deemed necessary. If the University does not substantiate sex discrimination by the course instructor, no corrective action shall be required by the University with respect to complainant’s allegations.

Remedies for the Complainant. A. The College will remove the October 4, 2013, and October 9, 2013 expulsion letters from the complainant’s academic record. The College will inform the Complainant, in writing, that the College has removed the expulsion from her academic record. The College may also inform the Complainant that if she wishes to re-enroll at the College, she will be required to apply for admission. The College will use the same admissions criteria that it uses for all applicants to evaluate the Complainant’s application for admission.
Remedies for the Complainant. By July 15, 2017, the College will complete an investigation of the complainant’s complaint that she was subjected to a racially hostile environment during a class on XXXXXXX XX, XXXX, In its investigation of the complainant’s complaint, the College will, at a minimum, allow the complainant an opportunity to provide information to the College in support of her complaint and identify any relevant witnesses; provide alleged respondent(s)(if identified) an opportunity to provide information to the College and identify any relevant witnesses; conduct a detailed review of all information the parties provide to the College; interview College staff and other witnesses to the alleged conduct, as appropriate; and, make a determination regarding whether the evidence presented, together with such additional information and witnesses as may be identified or presented, supports by a preponderance of the evidence a finding that harassment occurred that created a hostile environment for the complainant; and if so, the College will take prompt and effective action reasonably calculated to stop the harassment, prevent its recurrence, and as appropriate, remedy its effects. The outcome of the investigation will be communicated to the parties.
Remedies for the Complainant. By November 15, 2021, the University will make a written offer to the Complainant to allow her to retake, or audit, at her discretion, XXXXXXXXXXXXXXXXXXXXXXXX Statistics (the Course), or a similar course that would fulfill the same prerequisite requirement(s) as the Course for the Complainant’s academic progression at the University, without cost, with all approved academic adjustments and auxiliary aids/services, including any academic adjustments and auxiliary aids/services identified in the University’s policies, procedures, or practices identified in Item 2, below. The offer will specify that the Complainant has thirty (30) days to respond, and it will specify when the Complainant can avail herself of the Course or the similar course (e.g., the spring 2022 semester, or fall 2022 semester). If the Complainant elects to retake the Course or a similar course, the University will replace her grade on her transcript for the Course with whatever grade the Complainant earns upon retaking the Course or a similar course. If the Complainant elects to audit the Course or a similar course, the grade she received for the Course during the spring 2021 academic semester will remain on her transcript.

  • Remedies for Contractor Breach Pertaining to contract-related issues, it is the responsibility of both the Agency and the Contractor to communicate with each in as clear and complete a manner as possible. If at any time during the term of this contract the Agency or the Contractor is not satisfied with any issue, it is the responsibility of that party to deliver to the other party communication, in writing, fully detailing the issue and corrective action (please note that the Agency has the right to issue unilateral addendums to this contract, but the Contractor does not have the same right). The other party shall, within 10 days, respond in writing to the other party (however, the Agency shall retain the right to, if conditions warrant, require the Contractor to respond in a shorter period of time). Further, the Agency shall, at a minimum, employ the following steps in dealing with the Contractor as to any performance issues:

  • Remedies for Non-Compliance The Recipient agrees that if FTA determines that the Recipient or a Third Party Participant receiving federal assistance under 49 U.S.C. chapter 53 is not in compliance with 49 C.F.R. part 655, the Federal Transit Administrator may bar that Recipient or Third Party Participant from receiving all or a portion of the federal transit assistance for public transportation it would otherwise receive.
