Residential Phase Clause Samples

The 'Residential Phase' clause defines the specific period or stage of a project during which residential construction or development activities take place. This clause typically outlines the commencement and completion dates for residential work, the scope of activities permitted, and any special requirements or restrictions applicable to residential areas, such as noise limitations or access controls. Its core practical function is to clearly delineate the timeline and operational boundaries for residential development, ensuring that all parties understand when and how residential work is to be conducted, thereby minimizing disputes and coordinating project phases effectively.
Residential Phase. If no building permit is issued for a Building in the Residential Phase prior to the Outside Building Permit Issuance Date or under Section 3.2.3 above, all rights and obligations under this Development Agreement pertaining exclusively to the Residential Phase, for which the obtaining of a building permit is condition precedent, shall automatically terminate and be of no further force or effect. Notwithstanding the foregoing, if a building permit is issued for a Building in the Creative Office Phase, the obligations of the Developer(s) of the Creative Office Phase relating to improvements on the Residential Phase shall remain in full force and effect.
Residential Phase. 1.5 spaces per unit (0.5 spaces per unit shall be shared in accordance with the Bergamot Area Plan).
