Residential Phase. The following provisions shall apply to any Phase which is developed for Type I market-rate multifamily residential uses within the Project (herein, a "Residential Phase"):

Residential Phase. If a Certificate of Occupancy has been issued for one or more Residential Buildings but no Certificate of Occupancy has been issued for a Creative Office Building, for purposes of this Section 2.7.1(d), the term “Trip Generation Limit” means the PM peak hour trip generation based on the EIR for the Residential Buildings: 153 trips prior to the Outside Building Permit Issuance Date or January 1, 2025, whichever is earlier, and 147 trips thereafter.
Residential Phase. 1.5 spaces per unit (0.5 spaces per unit shall be shared in accordance with the Bergamot Area Plan).
Residential Phase. If no building permit is issued for a Building in the Residential Phase prior to the Outside Building Permit Issuance Date or under Section 3.2.3 above, all rights and obligations under this Development Agreement pertaining exclusively to the Residential Phase, for which the obtaining of a building permit is condition precedent, shall automatically terminate and be of no further force or effect. Notwithstanding the foregoing, if a building permit is issued for a Building in the Creative Office Phase, the obligations of the Developer(s) of the Creative Office Phase relating to improvements on the Residential Phase shall remain in full force and effect.

The ARCHITECT/ENGINEER shall prepare for the State a revised accounting of how the Project is responding to LEED criteria. 1.1.6.4. The ARCHITECT/ENGINEER shall submit to the State a revised Statement of Probable Construction Cost based thereon for and until approved by the State.
