Common use of Retention of Seniority Clause in Contracts

Retention of Seniority. ‌ (a) Laid off regular employees shall retain their seniority and perquisites accumulated up to the time of layoff for a period of one year and shall be rehired, if the employee possesses the capability of performing the duties of the vacant job, on the basis of last off - first on.
