Common use of Retention of Seniority Clause in Contracts

Retention of Seniority. An employee in the bargaining unit who is laid off because of lack of work or funds and who is recalled within four years shall regain the seniority he/she had and shall be credited with the accumulated sick leave to which he/she was entitled at the time he/she was laid off. An employee who is not recalled within four years shall be considered terminated.
