Common use of Retention of Seniority Clause in Contracts

Retention of Seniority. It is agreed between the parties hereto that seniority shall be retained and accumulated on the following basis: 1. Employees who are laid off after less than one (l) year's service shall retain their seniority for a period of six (6) months. 2. Employees who are laid off after one (l) year of service shall retain their seniority for a period of time equal to their length of service to a maximum of three (3) years. 3. Absence due to bona-fide sickness, provided such sickness is attested to by a qualified medical practitioner. 4. Authorized leave of absence. 5. Absence while serving in the Armed Forces, during a national emergency and for a period of ninety (90) days after honourable discharge.
