Common use of Return from Unpaid Leave Clause in Contracts

Return from Unpaid Leave. When an employee returns from an unpaid leave of absence of one (1) year or less, the employee shall return to the same position he/she left. If the position no longer exists, the employee shall exercise his/her rights to displace as provided in Article 8.B.3. If the unpaid leave of absence is for more than one year, the employee may return to the first comparable open position in his/her category.
