Common use of Return from Unpaid Leave Clause in Contracts

Return from Unpaid Leave. Nurses who have been granted an unpaid leave of absence of two (2) months or less shall return to their previous position and shift. Nurses who return from an unpaid leave of absence in excess of two (2) months shall, whenever possible, return to their previous position. When this is not possible, the nurse shall be given preference in filling other position vacancies for which the nurse is qualified consistent with the provisions of this Agreement. This provision is not applicable to any qualified leave of absence under the Family Medical Leave Act of 1993, except as otherwise permitted by law.
