Common use of Return to Work After Leave of Absence Clause in Contracts

Return to Work After Leave of Absence. Full-time and regular part time employees returning from Employer approved leaves of absence will be reinstated to their former job classification. The provisions of the foregoing notwithstanding, the Employer reserves the right not to reinstate to his former job classification any employee who no longer has the necessary qualifications, skill and ability to perform the work in an effective and efficient manner.
