EXTENDED LEAVES OF ABSENCE. A. Extended Leaves of Absence: As applicable, staff members employed during the 2015-16 school year will be “grandfathered” under the terms of the previous language. Provision has been made by the Board of Education for absence from duty of Professional Employees as follows: Health Leave Association Business Leave Parental Leave Military Leave Foreign Travel or Teaching - Academic Study Personal All requests for extended leaves of absence will be applied for and those approved shall be granted in writing. Professional Employees requesting reassignment upon completion of an extended leave of absence will be assigned to the first available position based upon their professional preparation, experience, and certification. Except for Association Business Leave and Military Leave, if a vacancy is not available by the beginning of the second year following the completion of the leave, the leave status ends and the Professional Employee is terminated from the district. Part-time Professional Employees who go on Extended Leave of Absence should not expect to return to a position which would increase their contract time. A part-time Professional Employee returning from Extended Leave of Absence may be offered a position of greater contract time.
B. Health Leave (extended) Any Professional Employee, having served the district for a minimum of three years, or with approval from the Superintendent and/or their designee, whose personal illness or physical incapacity extends beyond accumulated Xxxx Leave will be granted leave of absence without pay or increment for the remainder of the current semester. Health leave may be extended for one additional semester with application, as appropriate and available, made no less than 30 days prior to the conclusion of the current semester. In cases where such notice is not available, consideration will be made at the discretion of the Superintendent and/or their designee. At such time as the employee is diagnosed by their medical advisor as able to return to work, the employee may be returned to a position for which they are licensed, provided one is available, at the beginning of the subsequent semester or school year. Under no circumstances will an employee be entitled to return to a position.

EXTENDED LEAVES OF ABSENCE. A. The employer agrees that one (1) teacher designated by the Association will, upon request, be granted a leave of absence, without pay, for the purpose of engaging in Association (local, state, or national) activities. In the event a teacher is on leave of absence for the purpose of serving as President of the Education Association of Plymouth and Xxxxxx, the following additional provisions shall apply:
1. The employer will issue the President's regular paycheck on a bi-weekly basis consistent with all other employees.
2. The EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of the President's salary according to Appendix A of the Collective Bargaining Agreement.
3. If the President is enrolled, the EAPC will reimburse the employer on a quarterly basis during the course of the school year for the cost of ten (10) months premium payments (excluding August and September following President's term) in the existing health and life insurance plan.
4. Upon return from such leave, an employee will be considered as if he/she were actively employed by the Committee during the leave and will be placed on the salary schedule at the level he/she would have achieved if he/she had not been absent.
B. Military leave and other statutorily provided leaves shall be in an unpaid status, limited to the period provided in the law, and subject to the same benefits as all other unit members who are in an unpaid leave status: except those benefits provided specifically by the law. Requests for such leaves are to be provided the School Department by written notice. In the case of military leave, employees are to submit copies of military orders before the beginning of the leave which verify, if possible, the return date. Leaves granted under this section are to meet notification requirements listed in section I of this Article.
C. A leave of absence, without pay, of up to two (2) school years will be granted to any teacher with professional teacher status who joins the Peace Corps or serves as an exchange teacher, and is a full-time participant in either of such programs. EXTENDED LEAVES OF ABSENCE. 22.1 LEAVES WITHOUT PAY
22.1.1 Upon submission of the proper leave of absence form to the Human Resources Division, any post-probationary employee may request, upon showing good and sufficient reasons, a leave of absence without pay for one (1) year or more. Such leaves are subject to the approval of the Area Superintendent or Assistant Superintendent, Human Resources upon notification of the principal/supervisor. Leaves of less than one (1) year may be approved by the Area Superintendent or Assistant Superintendent, Human Resources. Applications for leaves of absence shall be submitted no later than April 1. In extenuating circumstances, applications submitted after April 1 may be approved by the Area Superintendent or Assistant Superintendent, Human Resources. (2007)
22.1.2 Written notice must be filed with the Human Resources Division by March 1 of the year in which leave is effective, stating whether or not the employee plans to return. Failure to give such notice will automatically forfeit the right of the employee to return. The Area Superintendent or Assistant Superintendent, Human Resources may, at his/her discretion, approve the leave for an additional period of up to twelve (12) calendar months if unusual or extenuating circumstances are demonstrated. 22.1.3 The request to extend the leave of absence must be made not later than March 1 of the year in which the leave is effective. After March 1, in cases of extreme emergency, a leave may be extended with approval of the Area Superintendent or Assistant Superintendent, Human Resources. (2001)
22.1.4 Employees granted a leave of absence will return to duty at the same status on the salary schedule, unless the employee has qualified for advancement, as shown at the date leave was granted. He/she shall also be credited with the unused sick leave accumulated at the time the leave of absence was granted. 22.1.5 Should a leave of absence extend beyond one (1) year, the employee’s position at the site may be filled with a standard contract. The Committee agrees that up to two (2) teachers designated by the Association may, upon individual request to the Committee, be granted a leave of absence for up to four (4) years without pay for the purpose of serving as an elected officer in a local, state, or the National Education Association. Upon return from such leave, a teacher will be considered as if they were actively employed by the Committee during the leave and will be placed on the salary schedule at the level they would have achieved if they had not been absent. B. A leave of absence without pay of up to two (2) years will be granted to any teacher who serves as full time exchange teacher, and is a full-time participant in either of such programs. C. Military leave will be granted to any teacher who is inducted or enlists in any branch of the armed forces of the United States. Upon return from such leave a teacher will be placed on the salary schedule at the level which they would have achieved had they remained actively employed in the system during the period of their absence up to a maximum of two (2) years.
D. A leave of absence without pay or increment of up to one (1) year may be granted at the discretion of the Superintendent of Schools or their designee for the purpose of caring for a sick member of the teacher's immediate family. The exercise of such discretion will be reasonable. Additional leave may be granted at the sole discretion of the Superintendent of Schools or their designee.
E. The Superintendent of Schools or their designee may grant a leave of absence without pay or increment to any teacher to campaign for or serve in a public office. The exercise of this discretion will be reasonable.
F. After five (5) years continuous employment in the Framingham Public Schools a teacher may be granted a leave of absence without pay for up to one (1) year for health reasons.

EXTENDED LEAVES OF ABSENCE. A. The Board agrees that up to one (1) teacher who has achieved tenure and is designated by the Association will, upon request, be granted a leave of absence without pay or other benefits for a minimum of one (1) year for the purpose of engaging in Association (local, state, or national) activities. In addition, a tenured teacher who is elected MSEA president or vice-president or NEA president or vice president will, upon request by HCEA, be granted a leave of absence without pay or other benefits for the year(s) the teacher is president.
1. An individual elected to serve as President of the Xxxxxx County Education Association shall become or remain a full time employee of the Xxxxxx County Public School System and shall be granted leave status for the period of his/her term. For individuals who are part-time prior to being elected president, there is no guarantee of a return to a part-time position once the term expires.
2. During his/her term, the President of HCEA shall be placed on the top step of the salary schedule labeled 12-month Coordinator/Staff Development Facilitator.
3. The salary and fringe benefits for the HCEA President will be paid by the Xxxxxx County Public School System and reimbursement will be made to the Xxxxxx County Public School System by HCEA.
4. Upon completion of his/her term(s), the HCEA President will return to a ten-month position and salary, subject to the terms of the Master Agreement.
B. A leave of absence without pay of up to two (2) years may be granted to any teacher on tenure who serves successfully in the Peace Corps, VISTA, National Teacher Corps, or serves as an exchange teacher or overseas teacher and is a full-time participant in either of such programs.
C. A teacher on tenure may be granted a leave of absence without pay for up to one (1) year for study. Additional leave may be granted at the discretion of the Board.
D. Military leave without pay will be granted to any teacher who is inducted into any branch of the Armed Forces of the United States for the period of said induction.
E. Tenured teachers, at their request, shall normally be granted a leave of absence for child rearing, without pay, for such a period of time as the teacher requests, but not to exceed two (2) years. EXTENDED LEAVES OF ABSENCE. 16-1 The school trustees agree that a maximum of four (4) teachers shall, upon request, be granted a leave of absence without pay for the purpose of serving in an elected or appointed office of the Association or another Association with which it is affiliated. To be eligible for leave the employee must have completed two (2) full years under contract with the School District. Such leave is granted for no less than one (1) full contractual year.

16-4 Employees who are members of any Reserve Unit of the Armed Forces of the United States or the National Guard who are ordered to active duty, or who are drafted, or who enlist as an alternative to being drafted, shall be granted military leave of
EXTENDED LEAVES OF ABSENCE. A. Employees who have acquired permanent appointment in the District may be granted leave of absence, which shall be without loss of permanent appointment, upon the recommendation of the Superintendent of Schools and the approval of the Board of Education. All requests for leaves of absence shall carry affirmation of intention of the applicant to return to an assignment in the District upon the termination of such leave. The permanent appointment requirement shall not apply in the case of request for maternity or military leave of absence. The Superintendent is also authorized to grant leave of absence to other employees under extraordinary circumstances deemed acceptable to him/her.
B. Employees shall make application for leave of absence, in writing, on a form provided for that purpose, obtainable in the supervisor’s or building principal’s office. The application shall be directed to the Chief Human Resources Officer, stating the specific reason for the leave. The application shall be filed at least thirty (30) days prior to the effective date of the leave. Employees shall furnish any evidence in support of their request as may be required by the Chief Human Resources Officer.
C. Leave of absence may be granted for a period of up to one (1) year. Special requests for periods of less than one (1) year may be granted at the discretion of the Superintendent. Employees on leave of absence shall notify the Director of Personnel in writing, prior to June 30, of their intention for the following school year. Return to duty from extended leave of absence shall be governed by the terms of the agreed upon length of the leave. Exceptions shall be permitted when, in the discretion of the District, there are good and sufficient reasons to do so, subject to applicable regulations.
D. Planned leaves of absence are contingent upon the availability of qualified regular substitutes. Regular substitutes shall be appointed and their names carried in the minutes of the Board of Education as “Regular Substitutes,” along with the name of the employee for whom the person is substituting.
E. The Board of Education reserves the prerogative of recalling to service any or all employees who have been granted a leave of absence when an emergency or employee shortage makes such action necessary. EXTENDED LEAVES OF ABSENCE. A unit member, who wishes to be absent from her position before she is disabled by pregnancy, miscarriage, childbirth, or recovery therefrom, or beyond the termination of such disability, or both, may request such leave of absence in accordance with the provisions of this Agreement applicable to uncompensated leave. Such leave shall be unpaid and may be required by the Board, if granted, to commence and terminate at times which will least disrupt the continuity of the District's educational program.

B. Any eligible member of the Bargaining Unit whose personal illness extends beyond the period of compensation may be granted sick leave without pay for up to one school year for personal health reasons. Requests for such leave will be supported by appropriate medical evidence. As a condition of continuing approval, the member granted such leave will submit periodic medical reports. In no case will such time, both paid and unpaid, extend beyond a total of two (2) school years.
C. Maternity leave will be granted in accordance with Massachusetts General Laws, Chapter 149, Section 105D, all rulings and regulations of the appropriate state agencies.
D. If approved, unpaid FMLA (Family Medical Leave Act) leave petitioned for personal illness, family health care, or maternity purposes under defined Federal law, shall be concurrent and coterminous with other provided leaves herein, and except as provided below shall not be granted as added time. It is agreed that an FMLA leave would provide four (4) additional weeks of unpaid leave to a person who took a maternity leave pursuant to Massachusetts General Laws, Chapter 149, Section 105D. Such FMLA leaves, if approved, may be granted no more than once during any given year from July 1st through June 30th.
E. The employer agrees that one (1) member designated by the Association will, upon request, be granted a leave of absence, without pay, for the purpose of engaging in Association (local, state, or national) activities. EXTENDED LEAVES OF ABSENCE. L16.01 An Extended Leave of Absence may be granted by The Hastings and Xxxxxx Xxxxxx District School Board to a Teacher.
L16.02 Seniority will accrue on a full-time basis to all Teachers during the period of any leave granted by the Board.
L16.02.01 Where a Teacher reduces teaching assignment from full-time to part-time, seniority will accrue to the Teacher on a full-time basis. The reduction in time, if approved by the Board, will be considered a part-time leave of absence.
L16.03 Leaves of absence will be rescinded if the Teacher's employment is terminated prior to the commencement of the leave due to Transfer & Surplus procedures.
L16.04 Applications for extended leaves of absence must be made in writing to the Superintendent of Human Resources.
L16.05 Every effort should be made to apply by April 30 or November 30 prior to the leave.
L16.05.01 The Superintendent of Human Resources will consider approving two (2) year leaves when there is documentation to support the need for such a leave.
L16.06 Following the expiry of the agreed leave period, if that leave period is two (2) consecutive school years or less, the Teacher will be returned to a position with the Board in the same school, subject to the procedures of the Transfer and Surplus Policy. Following the expiry of the agreed leave period of beyond two (2) consecutive school years, the Teacher will be returned to a similar position with the Board within a secondary school, subject to the procedures of the Transfer and Surplus Policy. In no case will a leave under this Article be greater than three (3) consecutive school years.
L16.07 No salary will be paid by the Hastings and Xxxxxx Xxxxxx District School Board except where otherwise stated in the leave plan.
L16.08 All Board administered benefits become the responsibility of the Teacher except where otherwise stated in the leave plan.
08.01 Teachers may continue benefit coverage through the Board at their own cost. Payment for benefits is to be as mutually agreed by the Teacher and the Board.
