Physical and Mental Condition. I acknowledge that at the time of signing this Agreement I am in sufficient physical and mental condition to engage in sport shooting on this range.
Physical and Mental Condition. I acknowledge that at the time of signing the Outdoor Shooting Range Membership Application & Agreement I am in sufficient physical and mental condition to engage in sport shooting on the Range.
Physical and Mental Condition. Employee represents that he is in good physical and mental health, has no chronic illness nor any prior physical or mental problems, the recurrence of which would impair his ability to function under all the terms and conditions of this Agreement.
Physical and Mental Condition. (A) All employees shall maintain their physical and mental condition at a level that enables them to properly and efficiently perform the essential functions of their position with or without reasonable accommodation. The Fire Chief may, at his discretion, require any employee of the District to submit to a physical or mental examination by a physician selected by the District to determine the individual's fitness for duty. The expense of this examination shall be paid by the District.
(B) If a deficiency or condition is found which interferes with the employee's ability to perform the essential functions of his or her position with or without reasonable accommodation and is correctable according the physician, the employee shall make every effort to follow the physician's instructions to correct the condition. Failure to make a reasonable effort and achieve acceptable results within a reasonable period of time shall be cause for disciplinary action.
(C) If the employee presents a medical opinion that disagrees that the employee is unfit for duty, the District and employee will jointly select a third physician to resolve the fitness for duty issue in accordance with NFPA 1582 standards. The third physician must be a board-certified medical doctor that practices in the field in which the fitness for duty is at issue.
(D) If an employee is required to submit to a physical or mental examination by the District and the physician (or after appeal the third physician) determines that the employee is unfit for duty, the employee may be charged leave for any days absent from work. The employee shall continue to be paid his regular salary and shall not be charged leave until a physician (or after appeal the third physician) rules the employee unfit for duty. The parties shall cooperatively work to establish agreed upon physicians who are approved for the third physician process. Employees shall promptly report to the third physician’s appointment, which may be scheduled by the District.

Condition of Equipment. I have, prior to engaging in any spot shooting at Triad Training LLC determined that, by professional standards, my shooting equipment, ammunition and all corresponding items are in good condition and suitable for the shooting contemplated by this Agreement.

I hereby attest and verify that I am physically and psychologically fit and have sufficiently trained to safely participate in the Event and all its related activities, and that, said condition has been verified by a licensed medical doctor. I attest and verify that I have evaluated my own physical and psychological condition and I warrant that said condition is such that I can safely participate in the Event without exposing myself, other athletes, members of other support teams, said Releases, or members of the general public to a risk of harm. I certify that the nature of the Event has been explained to me, the risks to me as an athlete, each member of the support team, other athletes and their support teams, and the general public. I realize that I may be subject to unannounced drug testing as provided for by USA Triathlon’s agreement. Further, as signature to this document, I hereby consent to receive medical treatment in the event of my injury, accident or sickness during the Event when such treatment is deemed as advisable by qualified medical personnel, and hereby WAIVE, RELEASE, FOREVER DISCHARGE, INDEMNIFY, HOLD HARMLESS AND AGREE NOT TO SUE any and all persons who advise or administer such treatment and their personal representatives, heirs and next of kin, successors, assigns, and each of them (hereinafter “Medical Personnel”) from any and all liabilities, actions, claims, demands, costs and expenses, including attorney’s fees and cost arising out of or in any way connected with treatment or action by said Medical Personnel, including but not limited to any property damages and/or losses, injuries and sicknesses, of whatever kind or nature whatsoever, whether known or unknown, including death, that may be suffered by me even if such are caused by the negligence, inattention, action, inaction, or intentional misconduct on the part of any said Medical Personnel.
