Right-of-Way Issues. Acquisitions of fee and Temporary Construction Easements (TCEs) will be required from residential and commercial properties. Acquisitions will also be required from the City of Marysville, Marysville High School, and a park owned by Yuba College District, along with four outdoor advertising signs (ODA). In addition, driveway conforms will be required for 9 parcels and new fence will be placed along the Marysville High School Parcels. With the implementation of the Marysville and Binney Junction Underpass and the involvement of UPRR tracks, there will have to be extensive UPRR coordination during the design and construction phases of the project. UPRR involvement includes a Railroad Clearance Memo, Right of Entry, Construction and Maintenance Agreement, and Right-of-Way Agreements for preliminary engineering. Full acquisition of at least eight buildings are required for the preferred alternative, including two single family residences, four commercial buildings, a public agency property, and a non-profit property. Anticipated total right-of-way cost of this alternative is $15,258,000. Railroads Union Pacific Railroad Agreement for separated-grade crossings at the Marysville Underpass and Binney Junction Underpass would be needed. Relocation Impact Studies Relocation Assistance Program (RAP) displacements will be required for the affected single-family residences, multi-family residences, and businesses/non-profits. Based on the Relocation Impact Study, dated March 18, 2020, sufficient replacement housing will be available without last resort housing. Based on market research, there will be sufficient single-family residences and commercial properties that are equal to or better than the displacement properties available for rent or purchase for either project alternative. Right-of-Way Issues. A Right-of-Way Data Sheet has been prepared for the recommended preferred alternative and is included in Attachment F.
Right-of-Way Issues. Right of way acquisition is required. An additional 2.54 acres of permanent right of way and 0.27 acre of Temporary Construction Easement (TCE) would be needed for this project. The project would require right of way acquisition from farmland in possession of Xxxxxxxxxx Act contract. The project is not anticipated to result in relocations because the proposed new right of way acquisition would not result in relocation. Utility relocation is required. Gas lines, electrical power lines, cable, communication lines and telephone power poles need to be relocated. Utilities on the bridge will be located onto the new bridge. The Right-of-Way Data Sheet and biological mitigation estimate are included in Attachment G. The Southern Pacific Railroad has tracks that run parallel to SR 1 approximately 900 feet to the east of the project location. This project would have no impact to the railroad and no railroad involvement is anticipated.
Right-of-Way Issues. The Right of Way Data Sheet is in Attachment H of this report. There are no anticipated right of way acquisitions or utility conflicts for this project. Railroad Coordination is anticipated for work at the Lake Washington Overhead. An agreement with the UPRR will be required for the installation of the fiber optic conduit on the bridge barrier.

  • Right of Way 8.1 The Site The site of the Project Highway (the “Site”) shall comprise the site described in Schedule-A in respect of which the Right of Way shall be provided by the Authority to the Contractor. The Authority shall be responsible for:

  • Special/temporary right of way The Concessionaire shall bear all costs and charges for any special or temporary right of way required by it in connection with access to the Site. The Concessionaire shall obtain at its cost such facilities on or outside the Site as may be required by it for the purposes of the Bus Terminal and the performance of its obligations under this Agreement.

  • Width 6.7.4.1.1. The minimum width at the child-restraint straps which contact the dummy shall be 25 mm. These dimensions shall be measured during the strap strength test prescribed in paragraph 7.2.5.1. below, without stopping the machine and under a load equal to 75 per cent of the breaking load of the strap.

  • Right of Way and Real Property The party named in Article 1, Responsible Parties, under AGREEMENT is responsible for the provision and acquisition of any needed right of way or real property. The Local Government shall be responsible for the following:

  • Rights of Way Each of the MarkWest Entities has such consents, easements, rights-of-way, permits or licenses (collectively, “rights-of-way”) from each person as are necessary to conduct its business in the manner described, and subject to the limitations contained, in the Pricing Disclosure Package and the Prospectus, except for (i) qualifications, reservations and encumbrances that would not have a Material Adverse Effect and (ii) such rights-of-way that, if not obtained, would not have, individually or in the aggregate, a Material Adverse Effect; other than as set forth, and subject to the limitations contained, in the Pricing Disclosure Package and the Prospectus, each of the MarkWest Entities has fulfilled and performed all its material obligations with respect to such rights-of-way and no event has occurred that allows, or after notice or lapse of time would allow, revocation or termination thereof or would result in any impairment of the rights of the holder of any such rights-of-way, except for such revocations, terminations and impairments that would not have a Material Adverse Effect; and, except as described in the Pricing Disclosure Package and the Prospectus, none of such rights-of-way contains any restriction that is materially burdensome to the MarkWest Entities, taken as a whole.
