Rights and Obligations of FPTS. Quyền của FPTS/Rights of FPTS - Được quyền thu phí theo biểu phí công bố hoặc theo thỏa thuận với Khách hàng và được quyền thay đổi Biểu phí dịch vụ. Biểu phí thay đổi sẽ được FPTS thông báo tại các địa điểm giao dịch của FPTS và website xxx.xxxx.xxx.xx trước khi có hiệu lực/Collect fees as per the applicable Service Tariff or agreement with the Customer and make changes to the Service Tariff. Any change to the Service Tariff shall be announced in FPTS’s offices and on the website xxxx://xxx.xxxx.xxx.xx before its effectiveness; - FPTS có thể từ chối, tạm ngừng hoặc chấm dứt cung cấp dịch vụ giao dịch chứng khoán, dịch vụ giao dịch trực tuyến đối với Khách hàng vì bất kỳ lý do gì mà không cần báo trước khi FPTS thấy là cần thiết, bao gồm nhưng không giới hạn ở các trường hợp/FPTS may refuse, suspend or terminate the provision of securities transaction services and online transaction services for the Customer for any reason without prior notice when FPTS deems it necessary, including but not limited to the cases hereinafter: o Khách hàng vi phạm quy định của FPTS hoặc của pháp luật về việc sử dụng và quản lý tài khoản giao dịch; hoặc/The Customer commits a breach of regulations of FPTS or law on use and management of transaction account; or o Theo quy định của pháp luật hoặc theo yêu cầu của cơ quan nhà nước có thẩm quyền; hoặc/Abide by the law or comply with the request of competent authorities; or o Các trường hợp liên quan đến giả mạo, gian lận; hoặc/Cases in connection with falsification and fraudulence o Khi lợi ích của FPTS / Khách hàng có thể bị tổn hại; hoặc/When the interests of FPTS/Customer may be harmed; or o Khi FPTS tạm ngừng dịch vụ để bảo trì, nâng cấp hệ thống; hoặc/When FPTS temporarily suspends service for system maintenance and upgrading; or o Tài khoản giao dịch của Khách hàng tạm đình chỉ hoạt động hoặc bị đóng/The Customer’s transaction account is temporarily suspended or closed. Nghĩa vụ của FPTS/Obligations of FPTS - Cung cấp các dịch vụ cho Khách hàng theo nội dung của Hợp đồng này tuân thủ đúng các quy định của Pháp luật/Provide services for the Customer as per the contents of this Agreement in accordance with the law; - Cung cấp cho Khách hàng các thông tin, dữ liệu về Tài khoản Giao dịch và hoạt động giao dịch trên Tài khoản Giao dịch của Khách hàng/Provide the Customer with information and data in connection with his/her Transaction Account and transaction activities on his/her Transaction Account; - Cung cấp Bản sao kê tài kho...
Rights and Obligations of FPTS. 3.1 QUYỀN/ RIGHTS - Được quyền thu phí từ khách hàng và thay đổi Biểu phí dịch vụ./ Collect fees from the Customer and change the Service Tariff. - Được sử dụng tài sản ký quỹ của Khách hàng trong tài khoản ký quỹ để thực hiện nghĩa vụ ký quỹ với Trung tâm lưu ký chứng khoán Việt nam (VSD) và bù trừ bất cứ khoản lỗ nào đối với các vị thế mở của Khách hàng./ Use the Customer’s collateral assets in margin account to perform deposit obligations with the Vietnam Securities Depository (VSD) and pay compensation for any losses on open positions of the Customer. - Trường hợp Khách hàng không thực hiện đầy đủ nghĩa vụ thanh toán đối với FPTS, FPTS xx xxxxx xx xx xxx sản ký quỹ, vị thế trên Tài khoản giao dịch CKPS để thực hiện thanh xxxx xxx xxx xxxxx xx xx. Nếu số tiền trong Tài khoản giao dịch CKPS của Khách hàng vẫn không đủ để thực hiện nghĩa vụ của Khách hàng, FPTS xx xxxxx xx xx xxx sản trên Xxx xxxxx xxxx xxxx xxứng khoán thông thường của Khách hàng, hoặc yêu cầu Khách hàng sử dụng các tài sản khác để thực hiện nghĩa vụ của mình./ In the event that the Customer fails to fulfil his/her payment obligations to FPTS, FPTS shall have the right to handle margin assets and positions on the Derivative Trading Account to make the payment for such obligations. In the event that the amount of money on his/her Derivative Trading Account is not enough to perform such obligations, FPTS shall have the right to handle assets on his/her ordinary Securities Transaction Account or request him/her to use other assets to fulfil his/her obligations.
