Sample Application Code. Licensee’s Authorized Users may install, modify and use the Sample Application Code solely for purposes of facilitating use of validly licensed Software in accordance with this Agreement. Licensee may modify the Sample Application Code solely for the purposes of designing, developing and testing Licensee’s own software applications. However, Licensee is permitted to use, copy and redistribute its modified Sample Application Code only if all of the following conditions are met: (a) Licensee includes MidVision’s copyright notice (if any) with Licensee’s application, including every location in which any other copyright notice appears in such application; and (b) Licensee does not otherwise use MidVision’s or any of its suppliers name, logos or other MidVision or any of its suppliers trademarks to market Licensee’s application. Licensee agrees to defend, indemnify, and hold MidVision and its suppliers harmless from and against any claims or lawsuits, including attorneys’ reasonable fees, that arise or result from the use or distribution of Licensee’s applications, provided that MidVision gives Licensee prompt written notice of any such claim, tenders to Licensee the defense or settlement of such a claim at Licensee’s expense, and cooperates with Licensee, at Licensee’s expense, in defending or settling such claim.

Sample Application Code. Except as set forth in documentation relating to such code or in a separate agreement between You and ikeGPS, You may modify the source code form of those portions of such software programs that are identified as sample code, sample application code, or components (each, "Sample Application Code") in the Product documentation solely for the purposes of designing, developing and testing products and applications developed using ikeGPS software programs; provided, however, You are permitted to copy and distribute the Sample Application Code (modified or unmodified) only if all of the following conditions are met: (i) You distribute the compiled object Sample Application Code with Your application; and (ii) You do not use ikeGPS’s name, logos or other ikeGPS intellectual property to market Your product or application. You agree to indemnify, hold harmless and defend ikeGPS from and against all claims, losses, liabilities, damages, fees, expenses, and costs (including reasonable attorneys’ fees, court costs, damage awards, and settlement accounts) that arise or result from the use or distribution of the Sample Application Code.

You agree to indemnify, hold harmless and defend Adobe from and against any loss, damage, claims or lawsuits, including attorney’s fees, that arise or result from the use or distribution of your application. You may be granted additional rights to modify or distribute Adobe software code within documentation relating to such code and/or the Software or in a separate agreement between you and Adobe.

  • How to File an Appeal of a Prescription Drug Denial For denials of a prescription drug claim based on our determination that the service was not medically necessary or appropriate, or that the service was experimental or investigational, you may request an appeal without first submitting a request for reconsideration.   • Insurance Application An employee on unpaid leave is eligible to continue to participate in group insurance programs if permitted under the insurance policy provisions. The employee shall pay the entire premium for such insurance commencing with the beginning of the leave and shall pay to the School District the monthly premium in advance, except as otherwise provided in law. In the event the employee is on paid leave from the School District under Section 1. above or supplemented by sick leave pursuant to Section 2. above, the School District will continue insurance contributions as provided in this Agreement until sick leave is exhausted. Thereafter, the employee must pay the entire premium for any insurance retained.
