Pendahuluan Semakin tahun semakin besar kebutuhan akan tanah, baik untuk kepentingan pembangunan perumahan atau gedung maupun untuk pelaksanaan usaha, termasuk usaha pertanian, sedangkan tanah 1 Xxxxx Xxxxxx,XX.XX. adalah Xxxxx Xxxxx III Fakultas Hukum Universitas Batanghari Jambi xxx Xxxxx Tetap PS. Ilmu Hukum Fakultas Hukum Universitas Batanghari Jambi. kosong yang tersedia sudah semakin sedikit xxx tidak pula memiliki tanah sendiri. Dikarenakan tanah sendiri tidak ada atau sangat kecil sedangkan kebutuhan untuk usaha sangat besar, maka diperlukan pihak xxxx xxxx memiliki lahan tanah yang luas untuk menggunakan tanahnya. Pihak yang membutuhkan lahan tanah yang luas untuk usahanya tidak hanya orang perorangan melainkan juga suatu badan usaha. Salah satu badan usaha yang memerlukan lahan tanah yang cukup luas untuk usahanya di kabupaten Muaro Jambi adalah PT. Era Sakti Wiraforestama. Perusahaan ini membutuhkan lahan tanah yang luas guna usaha perkebunan kelapa sawit. Dari usaha yang dilakukan, akhirnya PT. Era Sakti Wiraforestama mendapatkan lahan tanah yang diinginkannya dengan menggunakan tanah xxxxx masyarakat kecamatan Xxxx Xxxx. Penggunaan tanah masyarakat adat Xxxx Xxxx untuk keperluan usaha perkebunan PT. Era Sakti Wiraforestama bukanlah terjadi dengan sendirinya xxx penguasaan semena-mena, melainkan diawali dengan suatu perjanjian kepada xxxxx masyarakat pemilik tanah tersebut. Perjanjian yang diadakan antara PT. Era Sakti Wiraforestama dengan masyarakat adat Xxxx Xxxx adalah perjanjian penggunaan tanah untuk keperluan usaha, yang dituangkan dalam surat perjanjian. Dalam perjanjian yang diadakan, ditentukan xxx xxx kewajiban masing-masing pihak, umumnya hak dari pihak PT. Era Sakti Wiraforestama dapat menggunakan tanah milik masyrakat adat untuk kegiatan usaha perkebunannya hingga jangka waktu yang ditentukan dengan kewajiban membayar sejumlah harga dari hasil perkebunan yang dilakukan xxx mengembalikan pengelolaan tanah tersebut kepada xxxxx masyarakat adat pada saat berakhirnya jangka waktu perjanjian. Sedangkan hak masyarakat adat selaku pemilik tanah selain mendapatkan bagian hasil perkebunan juga mendapatkan tanahnya kembali setelah berakhirnya perjanjian. Dikarenakan penggunaan tanah untuk usaha perkebunan memakan waktu yang cukup lama, maka banyak terjadi perubahan- perubahan dalam pelaksanaan perjanjian yang kadangkala tidak diketahui oleh pihak xxxxx masyarakat, sehingga merugikan xxxxx masyarakat itu sendiri. Dengan terjadinya perubahan-perubahan dalam pelaksanaan perjanjian tanpa diketahui oleh pihak xxxxx masyarakat adat Xxxx Xxxx, timbulah berbagai permasalahan berupa :
Povinnosti Zkoušejícího Investigator is responsible for the conduct of the Study at Institution. In particular, but without limitation, it is the Investigator’s duty to review and understand the information in the Investigator’s Brochure to ensure that all informed consent requirements are followed. IQVIA or Sponsor will ensure that all required reviews and approvals by applicable regulatory authorities and ECs are obtained. Zkoušející je odpovědný za provedení Studie ve Zdravotnickém zařízení. Konkrétně pak jde zejména, ale nejen o povinnost Zkoušejícího zkontrolovat a porozumět informacím obsaženým v Souboru informací pro zkoušejícího a zajistit dodržování všech požadavků týkajících se informovaného souhlasu. IQVIA nebo Zadavatel zajistí, že budou opatřena veškerá požadovaná kontrolní schválení od příslušných regulatorních úřadů a EK. Investigator agrees to provide a written declaration revealing Investigator’s possible economic or other interests, if any, in connection with the conduct of the Study or the Investigational Product, or the Sponsor. Zkoušející souhlasí, že poskytne písemné prohlášení vztahující se k potenciálním zájmům Zkoušejícího ekonomické či jiné povahy, či odhalí jiné zájmy, je-li jich, a to v souvislosti s prováděním této Studie či ve vztahu k Hodnocenému léčivu i ve vztahu k Zadavateli. Investigator agrees to provide a written declaration revealing Investigator’s disclosure obligations, if any, with the Institution in connection with the conduct of the Study and the Investigational Product. Zkoušející souhlasí, že poskytne písemné prohlášení, jež bude odhalovat závazky Zkoušejícího, jsou-li nějaké, a to vůči Zdravotnickému zařízení ve vztahu a v souvislosti s prováděním Studie a Hodnoceným léčivem. Investigator is duly licensed to conduct the Study and in good standing. Zkoušející má řádné a platné příslušné oprávnění k provádění Studie. Site agrees to provide prompt advance notice to Sponsor and IQVIA if Investigator will be terminating its employment relationship in the Institution or is otherwise no longer able to perform the Study. The appointment of a new Investigator must have the prior approval of Sponsor and IQVIA. Místo provádění klinického hodnocení souhlasí, že zašle předem promptní oznámení Zadavateli a IQVIA v případě, že Zkoušející ukončí pracovní poměr ve Zdravotnickém zařízení či nebude-li Zkoušející z jakéhokoli jiného důvodu schopen provádět Studii. Ustanovení nového Zkoušejícího bude podléhat předchozímu schválení Zadavatele a IQVIA.
Vynálezy Stávající vynálezy a technologie Zadavatele nebo Zdravotnického zařízení zakládají jejich samostatné vlastnictví a Smlouva na ně nemá žádný vliv. Kompletní práva, nároky a podíly ohledně veškerých vynálezů, know-how, autorských práv nebo jiných práv duševního vlastnictví, které vzniknou, budou vyvinuty nebo použity v praxi (včetně veškerých zlepšení nebo úprav), které i) používají, využívají nebo zahrnují Hodnocené léky; ii) jsou zahrnuty nebo předvídány v Protokolu; nebo iii) používají, využívají nebo zahrnují Důvěrné informace, zakládají výlučné vlastnictví Zadavatele (společně xxxx xxx „Vynálezy Zadavatele“). Zdravotnické zařízení je povinno bezodkladně písemně informovat PRA a/nebo Zadavatele o každém takovém Vynálezu Zadavatele, a tímto převádí (a zajistí, aby všichni členové studijního týmu převedli) na Zadavatele veškerá práva, nároky a podíly týkající se každého jednotlivého Vynálezu Zadavatele. Zdravotnické zařízení se zavazuje poskytnout Zadavateli na jeho náklady přiměřenou pomoc, xxx xxxx Zadavatel smluvně zajistit a vykonávat svá práva na takové Vynálezy Zadavatele. Zdravotnické zařízení má výlučný vlastnický titul ke všem vynálezům nebo objevům, které vzniknou nebo budou použity v praxi výhradně zásluhou Zdravotnického zařízení, a které nenáleží Zadavateli. 9.
Millwright Xxxxx be to assist and work under the direction and instructions I or A. He will work alone at times performing assignments in keeping with his training. During the course of his year, training must become proficient in good practices in the areas of fitting, aligning, lubricating and the operation of all shop tools and machines. In addition to the foregoing, he will be exposed to and the process of learning techniques required in trouble shooting key production machinery, pipe fitting, basic welding and machining but not be expected to display a high degree of proficiency in these areas at this point. Millwright Must be capable of performing the tasks of fittings, aligning, lubricating an able to operate all shop tools and machines. Must under direction become proficient in basic welding and pipe fitting as well as dismantling and reassembly of plant equipment. Under direction,will continueto develop skills in trouble shooting all plant equipment and improve his skills at machining part and be exposed to basic principles of hydraulics and pneumatic. He may work alone frequently, but occasionally will require direction and instructions form Millwright I or A. Millwright 11: be capable, without direction of fitting, aligning and lubrication and taking apart and reassembling plant equipment. In addition, is expected to be able to weld, operate shop tools and do pipe fitting as required. Must under direction, become proficient at effective methods of trouble shooting and repairing hydraulic, pneumatic and mechanical faults in plant machinery. I: Must be capable without direction of performing all practices under Xxxxxxxxxx Must under directionbecomeproficient at reading and understanding blueprints, all phases of installing new equipment, laying out hydraulic and mechanical drives and meet speed and power requirements correctly. Xxxxxxxxxx "A": Must he capable without direction, of performing all under Xxxxxxxxxx X, and Must take full responsibility for work done by himself or his assistant. Must he in possession of a Millwright Certificate or a Machinist Certificate or Welder Certificate. Millwrightspresently employed in this classification will not be required to have a Certificate.

Playground ~ The playground is primarily for the use of children under the age of twelve (12). Any child caught throwing rocks, vandalizing, or hitting or teasing other children will be asked to leave the playground. An adult or appropriate baby-sitter must accompany all children under the age of six (6) years old. Garbage ~ The storage, collection and disposal of refuse and garbage in the recreational camping areas shall be conducted as to create no health hazards, rodent harborage, insect breeding areas, accident or fire hazards, or air pollution. Bag all food garbage in plastic and tie shut before placing in the dumpster, to prevent odor and rodents which are drawn to the garbage area, such as skunks, raccoons etc. Dumpster is for normal daily household garbage, no large boxes, building supplies, carpets etc. Camper is to dispose of this type of garbage elsewhere. Garbage may be placed in dumpsters only. If a dumpster is full, do not place garbage on or around the dumpster, find an empty dumpster to place your garbage into. Bags of garbage may not be set outside your camper for any reason. Disposal or deposit of hazardous or toxic waste is prohibited. No gas, oil, batteries, or car fluids may be deposited into the dumpsters or around the dumpsters. Hazardous materials will not be disposed of by the garbage service. Disposal or deposit of furniture, barbeque grills, washer, dryers, and other large household items are NOT permitted on, in or around the dumpsters. Holding Tanks ~ There is no size restriction on holding tanks, however, they must be opaque XX xxxx/black water approved tanks. The on-site dump station may be used to empty tanks that hold 50 gallons or less. For tanks over 50 gallons Camper must contract with a pumping service to pump and remove tank contents from campground. No dumping of xxxx water onto the ground. Docks ~ Campground does NOT have a lifeguard on duty. The docks are privately owned. In order to be on someone's dock you must receive permission from the dock owner. An adult must accompany all children on the docks after dark. Life jackets are required for young children fishing off docks. Running, diving, and/or horseplay are not allowed on the docks. All debris and toys must be removed from the docks, beach and marina area. Inappropriate behavior, intoxication or shouting on docks is not allowed. Glass is not allowed on the beach area. Jet skies, wave runners, etc. are not permitted in the marina area. Tires cannot be left in the marina area under boats or tied onto docks. Fish House ~ Clean up fish cleaning facility when done with your fish cleaning and bag all fish remains. Fish cleaning house must be kept clean and all fish waste must be put into plastic bags and deposited into dumpster and cover on dumpster closed. No dumping of fish wastes into marina or dog waste stations! Swimming Pool ~ Campers are required to abide by all rules posted in and around the pool area.

CUKAI Jualan hartanah tersebut akan dikenakan cukai berdasarkan mana-mana Akta terkini atau selepasnya yang dikuatkuasa oleh Kerajaan Malaysia yang mana berkenaan. CAJ-CAJ: Sebarang tunggakan caj perkhidmatan atau penyelenggaraan tanpa faedah penalti lewat (jika ada) yang tertunggak xxx perlu dibayar kepada mana-mana pihak berkuasa yang berkenaan xxx/atau pihak Pemaju akan ditanggung oleh pihak Pemegang Xxxxx Xxx/Pemberi Pinjaman setakat tarikh jualan lelongan hartanah tersebut (tertakluk kepada maksimum 10% daripada harga rizab) yang akan dibayar daripada harga pembelian, dengan syarat bahawa Pemegang Xxxxx Xxx/Pemberi Pinjaman menerima xxx xxxx terperinci untuk caj perkhidmatan penyelenggaraan xxx penyata akaun yang dikeluarkan oleh pihak berkuasa xxx/atau pemaju yang berkaitan daripada Pembeli dalam tempoh sembilan puluh (90) hari dari tarikh jualan xxx jika gagal pembeli tidak akan layak untuk apa-apa pembayaran, xxx sebarang jumlah tertunggak yang perlu dibayar selepas tarikh jualan lelongan hartanah tersebut hendaklah ditanggung oleh pembeli.
