Scanning of Checks and Transmission of Files. (a) Customer shall properly install and use all software and hardware required by this Agreement or otherwise required for, or related to, the use of the Remote Deposit Service. Customer shall (i) endorse each Check to be deposited as follows "For Mobile Deposit Only" with the Customer’s endorsement above or below "For Mobile Deposit Only", (ii) scan the front and back of each Check to be deposited and thereby capture the image of the front and back of each Check and any other required data from, each Check and (iii) transmit the File containing the images of and all other required data and information from or pertaining to such Checks to Bank or its Processor in accordance with procedure provided by Bank to Customer ("Procedures"). The Procedures may be provided by Bank at the time that Customer enrolls in the Service or may be provided in any other manner selected by Bank. Bank reserves the right to amend the Procedures, with or without prior notice to Customer. Bank may also provide Customer with, or require Customer to establish, a User ID, a personal identification number and/or passwords and other procedures (collectively, "Authentication Method") to access the Remote Deposit Service. The specific Authentication Method will be described in the Procedures. Bank has no responsibility for establishing the identity of any person who uses Customer's Authentication Method. By accessing the Remote Deposit Service with Customer's Authentication Method, Customer authorizes Bank to complete the requested transaction(s) through the Remote Deposit Service. Any requests or instructions Bank receives from Customer through the Remote Deposit Service shall be considered "in writing" under all applicable law and shall have the same force and legal effect as writing signed by Customer. This includes, but is not limited to, inquiries, deposit transactions, Checks or other items deposited, Images, Files, changes to accounts or services, or any other communication you provide to us through the Remote Deposit Service using Customer's Authentication Method. Customer agrees to, at all times, (i) comply with the Procedures, (ii) safeguard the confidentiality and security of the Customer's Authentication Method and all other proprietary property or information Bank provides to Customer in connection with the Remote Deposit Service and (ii) notify Bank immediately if Customer has any reason to believe the security or confidentiality required by this provision has been or may b...

You shall (a) endorse each Check to be deposited in accordance with the Procedures, (b) scan the front and back of each Check to be deposited and thereby capture the image of the front and back of each Check and capture the MICR encoding on, and any other required data from, each Check and (c) transmit the File containing the images of, the MICR line from and all other required data and information from or pertaining to, such Checks and all batched ACH data and other information to us or our Processor in accordance with the Procedures. We reserve the right to amend the Procedures, with or without prior notice to you. We may also provide you with, or require you to establish, a User ID, passwords, tokens, certificates and other procedures (collectively, “Security Procedures”) to access the Remote Deposit Service.
